PAGE i OF 4 nDHAVE CQUWTY BOARD OF SUPERVISORS RECDROIMG FEE Q.DO Nt ......J ,,", RESOLUTION NO. 94-34 A RESOLUTION SETTING FORTa APPROVAL OF A PRELIMINARY SUBDIVISION PLAN AND PETITION OF EXCEPTION FOR BEAVER DAM HEIGHTS, TRACT 3503, BEING A SUBDIVISION OF A PORTION OF THE E~ NW~, AND NW~ NE~ SW~, SECTION 33, TOWNSHIP 41 NORTH, RANGE 15 WEST, LOCATED IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1994, a public hearing was conducted to determine whether approval should be granted for the Preliminary Subdivision plan and petition of Exception for BEAVER DAM HEIGHTS, Tract 3503, and ',;,'>. WHEREAS, the owner/developer of this tract is Arthur B. and Shirley A. Combe, P.O. Box 309, Littlefield, Arizona. The engineer/surveyor responsible for the preparation of the drainage report and design of this subdivision is Bulloch Brothers Engineering, Inc., Mesquite, Nevada, and Owens Surveying Outfit, Mesquite, Nevada, and . ,:,:.,':~;.,:' WHEREAS, this property is located approximately two miles north of the 1-15, Beaver Dam-Littlefield interchange on the west side of Mohave County Route 91 (abandoned U.S. Highway 91). Access from Route 91 is via Shirley Lane, and WHEREAS, the Preliminary Plan depicts subdivided into 14 single family residential lots from one acre to 1.1 acres, and 14.105 acres ranging in size WHEREAS, electric power will be provided by the developer and Dixie Escalante Rural Electric Association, telephone service by Rio Virgin Telephone Company, domestic water by individual wells, sewage treatment by on-site septic systems. Solid waste is to be transported to a collection site at the intersection of Mohave County Highway 91 and the old landfill road. Beaver Dam Fire Department will provide fire protection, and WHEREAS, a Petition of Exception request is submitted as follows. 1. Single-tiered lots .' RESOLUTION NO. 94-34 PAGE 2 OF 4 ~K 23~1 ~G ~lo \F~E~94- 6&6~) Page 2 i"_ This petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of exceptions from the subdivision regulations as outlined in Article 1.13, for the following reasons: 2. Due to the single-tiered lot structure and the impossibility of additional access to the subdivision from the south, west or east, a single cul-de-sac longer than 600 feet ;3 the only viable means of providing access. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because the dedicated road will not interfere with any public road or street; the lot configuration has nO influence on surrounding properties; and the longer cul-de- sac serves the subdivsion only. .<~,-:-\ '.::;/' This request will not nullify the intent or purpose of the Master plan of the County or other regulations because the proposed subdivision lies in a rural desert area that is sparsely populated. There are special circumstances or conditions affecting this property, as follows: 1. This property is located on a bluff, with the area to the immediate south being impossible to ever develop due to the topography. 2. The subdivision on the west is not a fully developed subdivision, nor are any of the surrounding properties. 3. Once again, this property lies unincorporated desert area that is and within a rural, sparsely populated, WHEREAS, at the public hearing before the Mohave County Planning Commission on January 12, 1994, the Commission recommended conditional approval of the requested Petition of Exception and Preliminary Subdivision Plan subject to the following: ..:,.......:;". The approval of this subdivision was based on the understanding of the Commission and the Board of Supervisors that all streets within the subdivision will be constructed in accordance with Standard Specification Nos. 161 and 101.lOC of the Mohave County Engineering Road Standards or better. Grading and drainage related improvements will be made as recommended by the design engineer in the submitted drainage reports and as approved by the County Engineer. 'l'he water quantity and quality will be approved by the Arizona Department of Water Resources. The water for the subdivision will be indivdual wells installed by the lot ownprs and approved by the Arizona Department of Environmental Health. Sewage will be by on-site septic systems approved by the Mohave County Department of Environmental Health. Electric and telephone service shall be provided by the developer to each lot in accordance with Arizona Corporation Commission regulations, Signed and ratified service contracts from all purveyors of service to this subdivision will be required by staff. All lots and street centerline monuments will be staked and monumented in accordance with Standard Specification No. 102 of the County Public Works Department. Fire protection will be provided by the Beaver Dam Fire Department; street name and regulator signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as recommended by the design engineer. As a condition of approval, the owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Subdivision Regulations. 2. easement shall be of Lot 13 and along boundary of the A one-foot vehicular non-access provided along the north boundary the entire length of the east subdivision. 3. Roadways on dedication instruments as submitted to the Mohave County Public Works Department are defined using tax parcels; applicant is to resubmit dedication instruments with correct legal descriptions. WHEREAS, notice of hearing has been met and published throughout this subdivision process as required by Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of Supervisors meeting for this date.
