A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE NE\ OF
SECTION 27, TOWNSHIP 18 NORTH, RANGE 22 WEST, FROM A-R
(AGRICULTURAL-RESIDENTIAL) AND C-2 (GENERAL COMMERCIAL) TO C-RE
(COMMERCIAL RECREATION) IN THE SOUTH MORAVE VALLEY AREA, MORAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held On January 3, 1994, a public hearing was
conducted to determine whether approval should be granted for a
rezone for the above described property to owners Gem Land
Company of Phoenix, Arizona, and
WHEREAS, the property is located eight miles south of
Bullhead City and west of Highway 95. The parcel is accessed
directly from Highway 95, then King Street, and
WHEREAS, land uses in the area consist of a residential home
located directly northeast of the property and a real estate
sales office directly east. Fort Mohave Indian Reservation land
is located to the north and east, with residential subdivisions
to the west and northeast, and
WHEREAS, the property is vacant and was previously used as
pasture land. The site has a lOa-foot pipeline easement running
across the northwest portion of the property and a small tree-
lined wash dividing it from east to west, and
WHEREAS, the applicant is proposing a nine-hole golf course
with a driving range and clubhouse, and
WHEREAS, review of Floodplain Map #040058-260SC indicates
this parcel is located in Zone B, an area between limits of the
100-year flood and 500-year flood, and
WHEREAS, the proposed zoning is in compliance with the South
Mohave Valley Area Plan, and is within the Urban/Building Overlay
Zone, and

1. The parcel be zoned C-RE/20A (Commercial-
Recreation/Twenty Acre Minimum Lot Size).
2. The only portion to be zoned C-RE/20A is that portion
shown on Exhibit "A".
3. The submittal of a site plan and drainage report.
4. Concurrence from authority of pipeline easement for any
activity within the pipeline easement.
5. Submi ttal of all necessary permits from ADOT for any
access from Arizona Route 95.
6. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the MOhave County
Subdivision Regulations and 102. 04-B of the Standard
Specifications.
7. The parcel will meet or exceed its respective acreage
exclusive of road easements.
8.
The Parcel Plat shall show any surface drainage and
FEMA flood zones.
9. That appropriate zoning, building, environmental and
floodplain permits be obtained prior to any
development. These permits will not be issued until
Parcel Plat recordation.
10. The rezone shall not become effective for 30 days after
final Board of Supervisors approval for the change in
classification, as per ARS 11-829E.
11 . I f these conditions are not met wi thin one year this
approval will be void. If at the expiration of this
period the property has not been improved to meet the
uSe for which it was conditionally approved, the Board
(after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a
public hearing to: grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification. This action is in accordance with
Arizona Revised Statues Annotated, Title 11, Chapter 6,
11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, December 19, 1993, and posted December
17, 1993, as required by Arizona Revised Statutes 6nd the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 3, 1994, APPROVED
this rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
