A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE NE\ OF
SECTION 5, TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM C-RE/36A
(COMMERCIAL RECREATION/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO
C-2H/3A (GENERAL COMMERCIAL HIGHWAY FRONTAGE/THREE ACRE MINIMUM
LOT SIZE) ZONE IN THE ARIZONA STRIP AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 6, 1994, a public hearing was
conducted to determine whether approval should be granted for a
Rezone for the above described property to owners Beaver Dam
Resort, Inc. of Littlefield, Arizona, and
WHEREAS, the property is located approximately one-half mile
north of 1-15 and east of Highway 91, The property is accessed
directly from Highway 91, and
WHEREAS, this item was reconsidered by the Planning and
Zoning Commission because it was advertised incorrectly. The
advertisement indicated that the property was being rezoned to C-
2H/3A (General Commercial Highway Frontage/Four Acre Minimum Lot
Size). The Planning staff corrected the error and notified the
surrounding property owners that the rezone would be heard again.
The Commission recommended approval of this rezone at the April
13, 1994, meeting, and
WHEREAS, this rezone was heard by the planning and Zoning
Commission on December 8, 1993. At that meeting the Commission
recommended denial for the proposed zone change. On March 1,
1994, the Board of Supervisors referred the item back to the
Planning and Zoning Commission. The Board indicated at the March
1, 1994, meeting that the rezoning before the Board On that date
was altered from the original recommendation presented to the
Planning and Zoning Commission. The Board would like to give the
CommisSion an opportunity to review this rezoning based on the
revised plan, and

WHEREAS, the subject parcel is a part of Beaver Dam Lodge
and Golf Course. Beaver Dam Resort R-V SubdiviSion is adjacent
to the proposed site for rezoning and is a part of a concept plan
that includes a lodge, recreation centers, trading post, golf
course and a Recreational Vehicle Park. The area was planned
with a number of phases. The only portions of the concept that
have been implemented are the lodge, golf course and a portion of
the R-V park directly south of the lodge, known as Beaver Dam
Resort, Tract 3015-A, recorded in October of 1987. The lots in
this R-V Park are individually owned, and
WHEREAS, the existing land uses surrounding the proposed
area to be rezoned consists of an R-V Park to the south, the
lodge and golf course to the east with a few commercial
businesses to the west. The remainder of the area is residential
and vacant land, and

WHEREAS, the area that is to be zoned commercial was
previously used as a storage and parking area by residents living
in the R-V park. There are four double-wide mobile homes stored
on the property which are in violation of the Mohave County
Zoning Ordinance, and
WHEREAS, there is a roadway dividing the property proposed
for rezoning that provides access to the lodge. The rezoning
will not create a parcel for sale but will define a parcel with a
different zoning designation. The area designated commercial
will remain under the same ownership as the lodge, and
WHEREAS, the lot size minimum has also been reduced from a
four-acre minimum lot size to a three-acre minimum lot size.
Surrounding property owners have also been notified of the change
in lot size and the proposed alteration of the lot to be rezoned,
and
WHEREAS, the Planning and Zoning Department has received
letters of opposition to the original proposal for a rezone that
abutted Beaver Dam Resort from some of the property owners in
Beaver Dam Resort, Tract 30l5-A. Many of the letters have
indicated they are opposed to this rezone to commerCial because
it is not part of the concept plan for Beaver Dam Resort and R-V
park. The concept plan indicates a convention center, health and
fitness center and a lake. The applicant has proposed a
compromise to reduce the impact of the commerCial property on the
surrounding area by providing a buffer between the site proposed
for rezoning and Beaver Dam Resort. A petition has been
submitted and signed by a number of the property owners in Beaver
Dam Resort indicating that they are not opposed to the new
rezoning proposal, and

WHEREAS, review of Floodplain Map #040058-0025B indicates
this parcel to be in Zones A and C. The portion in Zone A is an
area of 100-year flood; base flood elevations and flood hazard
factors not determined. The remainder of the parcel is in Zone
C, an area of minimal flooding. This parcel requires a
Floodplain Use permit for any development, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 11, 1994, the Commission
recommended APPROVAL for a rezone subject to the following:
1. The parcel be zoned C-2H/3A (General Commercial Highway
Frontage/Three Acre Minimum Lot Size).
2. That appropriate zoning/building/environmental permits
be obtained.

3. That the only portion of the property to be zoned C-
2H/3A is that portion designated in "Exhibit A".
4. The applicant comply with all applicable provisions of
the Mohave County Zoning Regulations and compliance
with Section 27.P (Site Plan Requirements).
5. The rezone shall not become effective until 30 days
after final approval of the change in classification by
the Board of Supervisors, as per ARS ll-829E.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
MOhave County, Arizona, May 22, 1994, and posted May 20, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 6, 1994, APPROVED this
rezone as recommended by the MOhave County Planning and Zoning
CommiSSion and outlined herein.
