WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held July 5, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Subdivision Plan of Desert Springs Ranchos, Tract 3029, and WHEREAS, the owners/subdividers of this property are Clayton and Sharon Eel] of Desert Springs, i'.rizona. The engiAeer responsible for the preparation of the drainage report and design qf this subdiv.i.sion is Ron Whitehead, P.E., Eush and Gudgell, 'inc., St. George, Utah, and WHEREAS, this subdivision is located approximately one-half mile northeast of Littlefield on Interstate 15. From Interstate 15, access is via the south frontage road (a county road), then southeast On proposed Desert Springs Road, which is the access for this subdivision, and WHEREAS, the preliminary plan depicts approximately 32 acres subdj.vided into 21 single family residential lots. Three of these lots are two acres; the remaining lots are one acre. The zoning is A-R (Agricultural-Residential), and ','),." WHEREAS, the water will be supplied by individual wells. Electric power is furnished by Dixie Escalante R.E.A., and telephone service has been provided to each lot by Rio Virgin Telephone Company, and WHEREAS, this subdivision was created prior to submission of an application, as required by Arizona State Statutes and Mohave County Subdivision Regulations. All but four lots were sold prior to the issuance of a Cease and Desist order from the Arizona Department of Real Estate. As recently as April 1, 1994, the Planning and Zoning office has received correspondence from concerned lot purchasers. The above order is still in effect. A stick-buil t home has been constructed on at least one lot, ane' the home builder cannot get clear title to the land, and RESOLUTION NO. 94-200 Page 2 PAGE 2 OF 2 BK 2430 PG J~6 (FEE~94-40368) WHEREAS, this subdivision is progressing towards recordation. The first submittal of the final plat was transmitted for review February 8, 1994. A correction letter was sent February 17, 1994. As-built Improvement Plans have not been submitted, and WHEREAS, Article 3.10 stutes, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings reluting to the plat shall be terminated," und WHEREAS, problems with the Extension in a letter dated May 2. 1994, Shuron Bell cites the completion of improvements as jus'tification for of Time, and WHEREAS, the Preliminary Subdivision Plan was approved by the Mohave County Board of Supervisors on May 1, 1991, via Resolution No. 91-115. Resolution No. 94-33 extended the Preliminary Plan until l"ay 1, 1994. This will be the second Extension of Time, and WHEREAS, at a public hearing on June 8, 1994, the Mohave County Planning and Zoning Commission recommended APPROVAL cf the requested Extension of Time subject to the following: 1. Compliance with all conditions as stated in BaS Resolution NO. 91-115. 2. This Extension of Time will be in effect until May 1, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohuve Co'U'nty, Arizona on June 19, 1994, us required by the Arizona Revised Statutes and the Mohave County Zoning Regulations.
