RESOLUTION NO. 94-185
A RESOLUTION SETTING FORTH A REQUEST FOR A REZONE OF PARCEL 35-7,
MOUNTAIN VISTA RANCHES, SECTION 35, TOWNSHIP 24 NORTH, RANGE 15
WEST, FROM A-R/36A, (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE
MINIMUM LOT SIZE) TO A-R/1QA (AGRICULTURAL-RESIDENTIAL/TEN ACRE
MINIMUM LOT SIZE) IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 6, 1994, a public hearing was
conducted to determine , whether approval should be granted for a
rezone for the above described property to owners Chris and
Holley Mousley of Kingman, Arizona, and
WHEREAS, the property is located north of Highway 66 and
west of Antares Road. The property is accessed from Highway 66
via Concho Drive, then north to Superstition Drive, then east to
an unnamed easement on the east side of the property, then south
to the site, and
WHEREAS, the surrounding land uses consist of vacant land
and residential homes in the Valle vista subdivision. The site
proposed for rezoning is vacant, and
WHEREAS, Mountain Vista Ranches is a 40-acre subdivision
divided by Record of Survey recorded December 15, 1993 in Book 11
of Records of Survey, Pages 34-34G, Mohave County, and
WHEREAS, the owner intends to divide the parcel into two 10-
acre parcels and one 2Q-acre parcel, and
WHEREAS, review of Floodplain Map #040058-20008 indicates
this parcel is located in Zone C, an area of minimal flooding,
and
WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on May 11, 1994, the Commission
recommended APPROVAL for a rezone subject to the following:
1. The parcels be zoned A-R/10A (Agricultural-Residential/
Ten Acre Minimum Lot Size).

2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations and l02.04-B of the Standard
Specifications.

3. That the Board of Supervisors accept the dedication of
a 42-foot road right-of-way on the south and west sides
of the parcel, and the dedication of a 20-foot radius
curve at the southwest corner of the parcel. In
addition the granting of an 8-foot PUE along the south
and west boundaries adjacent to the proposed dedicated
roadways. The dedications and grantings required by
the rezoning resolution shall be shown on the Parcel
Plat and accepted by the Board of Supervisors upon
Parcel Plat recordation.
4. Each parcel shall meet or exceed their respective
acreage exclusive of road easements.
5. Each parcel shall have legal access.
6. The Parcel Plat shall show any surface drainage and
FEMA flood zones.
7. That appropriate zoning, building, environmental and
floodplain permits be obtained prior to any
development. These permits will not be issued until
Parcel Plat recordation.
8. The rezone shall not become effective for 30 days after
final Board of Supervisors' approval for the change in
classification, as per ARS 11-829E.
9. If these conditions are not met within one year this
approval will be void. If at the expiration of this
period the property has not been improved to meet the
use for which it was conditionally approved, the Board
(after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development, or cause
the property to revert to its former zoning
classification. This action is in accordance with
Arizona Revised Statues Annotated, Title 11, Chapter 6,
11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 6, 1994, APPROVED this
rezone as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
