A RESOLUTION SETTING FORTH A REQUEST FOR A REZONE OF PARCEL 35,
LAZY Y-U RANCH, PHASE I, SECTION 10, TOWNSHIP 20 NORTH, RANGE 16
WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE
MINIMUM LOT SIZE) TO A-R/26A AND A-R/4A (AGRICULTURAL-
RESIDENTIAL/TWENTY-SIX ACRE AND FOUR ACRE MINIMUM LOT SIZES)
LOCATED IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on July 5, 1994, a public hearing was
conducted to determine whether approval should be granted for a
rezone for the above described property to owner McBrayer
Mortgage Inc. of Kingman, Arizona, and
WHEREAS, the property is located approximately three and
one-half miles southeast of the Kingman city limits. This land
is accessed via Hualapai Mountain Road to Lazy Y-U Drive, then
southwest to Tomahawk Drive, then southwest to the property, and
WHEREAS, there are several scattered residences to the north
and east of this area. Utilities have not been extended to the
southwest portion of Lazy Y-U Ranch, Phase I, and
WHEREAS, the property is vacant and is located in hilly
terrain. The proposed two northern parcels contain a large wash,
running southwesterly. A steep hill in the eastern portion of
Parcel 35 slopes down to a valley, west of Tomahawk Drive, and

WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on May 11, 1994, the Commission
recommended APPROVAL for a rezone subject to the following:
1. The two northern parcels be zoned A-R/4A (Agricultural-
Residential/Four Acre Minimum Lot Size) and the
southern parcel be zoned A-R/26A (Agricultural-
Residential/Twenty-six Acre Minimum Lot Size).

2. Submittal and recordation of a parcel plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102. 04-B of the Standard
Specifications.
3. The parcels shall meet or exceed their respective
acreages exclusive of roadways.
4. Each parcel shall have legal access.
5. The parcel plat shall show any surface drainage and
FEMA flood zones.
6. Roadway easement centerlines will be monumented beneath
the bladed road surface at all easement angle points
and coinciding parcel corners.
7. That appropriate zoning, building, environmental and
floodplain permits be obtained prior to any
development. These permits will not be issued until
parcel plat recordation.
8. The rezone shall not become effective for 30 days after
final Board of Supervisors' approval for the change in
classification, as per ARS ll-829E.
9. If these conditions are not met wi thin one year this
approval will be void. If at the expiration of this
period the property has not been improved to meet the
use for which it was conditionally approved, the Board
(after notification by registered mail to the owner and
applicant who requested the rezoning> shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development, or cause
the property to revert to its former zoning

Arizona Revised Statutes Annotated, Title 11, Chapter
6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, July 5, 1994, APPROVED this
rezone as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
