RESOLUTION NO. 94-181
A RESOLUTION SETTING FORTH A REQUEST FOR AN ABANDONMENT OF THE
15-FOOT ROADWAY EASEMENT ON THE EAST SIDE OF PARCEL 34-12,
SECTION 34 AND THE 15-FOOT ROADWAY EASEMENT ON THE WEST SIDE OF
PARCEL 35-7, SECTION 35, TOWNSHIP 21 NORTH, RANGE 14 WEST, IN THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 6, 1994, a public hearing was
conducted to determine whether approval should be granted for an
abandonment for the above described area to owners Donald Simonis
and Joseph Almeida of Kingman, Arizona, and
WHEREAS, the area proposed for abandonment is located south
of 1-40 and east of Blake Ranch Road. The area is accessed from
1-40 via Blake Ranch Road, then south to the I-40 Frontage Road,
then east to the section line easement between Sections 34 and
35, then south to the proposed abandonment, and
WHEREAS, the area has been subdivided into 40-acre parcels.
A few of these 40-acre parcels have been divided into smaller
parcels, and
WHEREAS, the surrounding land in the area is primarily
vacant with a few scattered homes, and
WHEREAS, the easement proposed for abandonment runs north to
south and provides access to parcels in Cedar Hills Ranches. The
easement has been improved and portions have been bladed. The
portion requested for abandonment has not been bladed; however,
the western side of the easement is improved enough to allow
vehicle traffic, and
WHEREAS, the proposed abandonment has been requested by two
property owners. Each owner is requesting the abandonment of the
15-foot portion of the easement on their property. The total
width of the easement is 30 feet. This abandonment request
removes the entire easement, and
WHEREAS, the owners have indicated that this road is not
being used by the public and that the easement is fenced and has
unlocked gates. The owners have also stated that they do not
want to abandon the easement for utility purposes, and

WHEREAS, the extension of this easement south of the
proposed abandonment has been recently bladed, indicating that
owners to the south will be using this easement, and
WHEREAS, review of Floodplain Map #040058-2375B indicates
this parcel is located in Zone C, an area of minimal flooding,
and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 11, 1994, the Commission
recommended DENIAL for an abandonment based on the following:
1. The easement in question falls on a section line. A
section line alignment for a road is generally
considered as an arterial route in the Mohave County
Subdivision Regulations. An arterial route is
designated with a right-of -way width of 84 feet (42
feet on each side of the section line) to accommodate
present or potential future traffic needs. The roads
in this area are substandard with 30 feet and are
spaced a great distance apart. Wi th the amount of
growth in this area and the po~ential for future growth
the abandonment of this easement would seriously
restrict traffic flow.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 6, 1994, DENIED this
abandonment as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
