PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERViSORS RECORDI~Q FEE 0.00 NC , MICROFILMED RESOLUTION NO. 94-179 A RESOLUTION SETTING FORTH A REQUEST FOR A REZONE OF PARCEL 3, GOLDROAD STATION, UNIT 6, SECTION 18, TOWNSHIP 20 NORTH, RANGE 18 WEST FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) TO A-R/16A AND A-R/10A (AGRICULTURAL- RESIDENTIAL/SIXTEEN AND TEN ACRE MINIMUM LOT SIZES) IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 6, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners John and Delores proffit of Kingman, Arizona, and WHEREAS, the property is located north of Oatman Highway and east of Desert View Trail. The property is accessed from Oatman Highway via Aquarius Drive, then west to Kingman Trail, then north to the property, and WHEREAS, the site is vacant with the surrounding area also vacant. There are a few scattered residential dwellings to the west, and WHEREAS, Goldroad Station Unit 6 consists of a number of 40- plus-acre parcels surrounded by a number of subdivisions with two and one-half acre lots, and WHEREAS, the owner intends to divide the property into three parcels, and WHEREAS, review of Floodplain Map #040058-2325B indicates this parcel to be in Zones A and C. The portion in Zone A is an area of 100-year flood, base flood elevations and flood hazard factors are not determined. The remainder of the parcel is in Zone C, an area of minimal flooding. This parcel requires a Floodplain use Permit for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 11, 1994, the Commission recommended APPROVAL for a rezone subject to the following: RESOLUTION NO. 94-179 Page 2 . . . 1. The southern parcels be zoned A-R!10A (Agricul tural- Residential!Ten Acre Minimum Lot Size) and the northern parcel be zoned A-R!16A (Agricultural-Residential! Sixteen Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdi vision Regulations and 102. 04-B of the Standard Specifications. 3. That the Board of Supervisors accept the dedication of a 20-foot radius curve at the southeast corner of the property at the intersection of Kingman Trail and Ute Drive. The dedication required by ~he rezoning resol~tion shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 4. The parcels will meet or exceed their respective acreage exclusive of road easements. 5. Each parcel shall have legal access. 6. The Parcel Plat shall show any surface drainage and FEMA flood zones. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective for 30 days after final Board of Supervisors' approval for the change in classification, as per ARS 11-829E. 9. I f these conditions are not met wi thin one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. PAGE 2 OF 1 BK 2417 PG 7S (fEE~9~-34603) RESOLUTION NO. 94-179 Page 3 . . . WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 6, 1994, APPROVED this rezone as recommended by the Mohave County Planning and zoning Commission and outlined herein.
