MOHAVE COUNTY RECORDER- 06/Q8/~~ 1'1~ P.~, PAGE 1 OF 3 rlDHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne MlC~OFllMED RESOLUTION NO. 94-178 A RESOLUTION SETTING FORTH A REQUEST FOR A REZONE OF LOT 14, BLOCK I, GOLDEN SAGE RANCHOS, UNIT 51, SECTION 1, TOWNSHIP 21 NORTH, RANGE 19 WEST FROM A-R/2A (AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) TO A-R/1A (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 6, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners Spiro and Milica Medigovich, Samuel Medigovich and Thomas Medigovich of San Diego, California, and WHEREAS, the property is located north of Highway 68 and east of Laguna Road. The property is accessed from Highway 68 by Milky Way Road, then north to Chino Road, then east to Laguna Road, then north to the property, and WHEREAS, the surrounding land uses consist of scattered re~idential homes and vacant land. The site proposed for rezoning is also vacant. The majority of homes in the area are located in Crystal Springs subdivision, located to the west of the property, and WHEREAS, the majority of Golden Sage Ranchos Unit 51 consists of two-acre lots, with a few lots divided into one-acre parcels, and WHEREAS, Laguna Road is on the west side of the site and is paved; electric service lines run adjacent to the eastern and western boundaries of the property, and WHEREAS, review of Floodplain Map #040058-2150B indicates this parcel to be in Zones A and C. The portion in Zone A is an area of 100-year flood, base flood elevations and flood hazard factors not determined. The remainder of the parcel is in Zone C, an area of minimal flooding. This parcel requires a Floodplain Use Permit for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 11, 1994, the Commission recommended APPROVAL for a rezone subject to the following: RESOLUTION NO. 94-l78 Page 2 . . . 1. The parcels be zoned A-R/1A (Agricultural-Residential/ One Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County SUbdivision Regulations and 102. 04-B of the Standard Specifications. 3. The parcels will meet or exceed their respective acreage exclusive of road easements. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective for 30 days after final Board of Supervisors' approval for the change in classification, as per ARS 11-829E. 8. If these conditions are not met wi thin one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 6, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
