',,~ .,~ \ '(,( ,I ~ ) IH" , 'j, t (I S" , \i.J',D M1CROFlLMED A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN AND PETITION OF EXCEPTION FOR BLACK HILLS RANCHOS, TRACT 3301, BEING A SUBDIVISION OF A PORTION OF THE NW~ OF THE NW!.i, SECTION 14, TOWNSHIP 21 NORTH, RANGE 19 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held June 6, 1994, a public hearing was conducted to determine whether approval should be granted for the Preliminary Plan and petition of Exception for Black Hills Ranchos, Tract 3301, and WHEREAS, the owner/developer of this tract is Black Hills L.L.C., c/o R.S.Y. Development, Inc., Bullhead City, Arizona. The engineer responsible for the preparation of the drainag~ report and design of this subdivision is Robert L. Schuetz, P.E., of Mohave Engineering Assoc. Inc., Kingman, Arizona, and WHEREAS, this property is located on the north side of Crystal Drive, on the west side of Estrella Road, approximately one mile south of State Highway 68. Access to the subdivision is from Crystal Drive, and WHEREAS, the Preliminary Plan depicts subdivided into 23 single family residential drainage parcel. The single family residential size from 8,000 square feet to 22,000 square feet, a density of 2.3 lots per acre, and WHEREAS, electric power and telephone will be provided by Citizens Utilities Company; water will be provided by the Golden Valley Improvement District; sewage treatment by on-site septic systems; and solid waste disposal by Mohave Disposal to the Mohave County Landfill. Golden Valley Fire Department will provide fire protection, and 10-p1us acres lots and one lots range in to provide for WHEREAS, a Petition of Exception request containing the following deficiencies was submitted as follows: 1. Proposed lots 1, 2, 3, 22 and 23 are double fronting lots. RESOLUTION NO. 94-174 Page 2 . " . . 2. Ten-foot public utility easements are proposed along the fronts of the lots rather than the l6-foot easements along the rear lot lines as called for in the regulations, and WHEREAS, this petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of exceptions from the subdivision regulations as outlined in Article 1.13 for the following reasons: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because: A. The double fronting lots are only proposed where the rear of the lots face on roads designated as Section-line or quarter-sectionline roads. This is for the purpose of limiting direct access from residential lots onto these roads. Physical barriers will be constructed along the rear of these double fronting lots so that access onto these roads will be prevented. B. It is proposed to place public utility easements along the front rather than along the rear of the lots because this location affords easier access to the easements than if they were along the rear lot lines. Further, with the easements along the front of the property, owners are able to fence along the rear lot lines and enjoy the full benefit of the yards. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because none of the proposed exceptions will affect anything outside of the subject property, and WHEREAS, at a public hearing on May 11, 1994, the Mohave County Planning and zoning Commission recommended APPROVAL of the requested Preliminary Subdivision Plan and Petition of Exceptions with the applicant understanding and accepting the following conditions: 1. The water quantity and quality will be approved by the Arizona Department of Water Resources. . The water distribution system, including adequate pressure and volume for fire flows, will be supplied by the Golden Valley Improvement District, will be constructed to serve each lot, and will be approved by the Arizona Department of Environmental Quality. . Sewage disposal will be provided by on-site septic systems to be approved by the Arizona Department of Environmental Quality. . Grading and drainage related improvements will be constructed as recommended by the design engineer in the submitted drainage reports and as approved by the County Engineer. . As a condition of approval, the owner/subdivider is responsible for the completion of these si te improvements and shall provide an assurance for all required subdivision improvements in accordance with Article v of the Subdivision Regulations. 2. Finished floor elevations for all lots within the FEMA flood zone will need to be set a minimum of one foot above the base flood elevation and shown on the Final Plat. 3. An on-site permanent benchmark will need to be used for this subdivision. 4. A water impact study will need to be submitted to the Golden Valley Improvement District prior to Final Plat recordation. 5. A separate instrument dedicating the south half of Crystal Drive will need to be acquired prior to the recordation of the Final Plat. 6. Six-foot block walls are to be constructed on a VNAE which runs along Lots 1, 2, 3, 22 and 23 adjacent to Estrella and Carrizo Roads. The developer is proposing to provide for the maintenance of these walls via deed restrictions. These lots have double frontage. 7. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board and a final copy shall be submitted to Planning and Zoning staff 8. The homes on Lots 16 through 23 shall be limited to three bedrooms. Homes on Lots 18, 22 and 23 shall be located on the lot in a manner which provides the required 50-foot separation distance between the drainage parcel and the septic system. 9. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona on May 22, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 6, 1994, APPROVED the Preliminary Plan and Petition of EKceptions for Black Hills Ranchos, Tract 3301, as recommended by the Mohave County Planning and zoning Commission, subject to the conditions outlined herein.
