MOHAVE COUNTY RECORDER, 06/08/94 1:15 f,R, PAGE 1 OF 5 MOHAVE COUNTY BOARD OF SUPERVISORS RECQRDrA~ FEE O.OD He MICROFILMED RESOLUTION NO. 94-170 A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN AND PETITION OF EXCEPTION FOR DESERT LAKES ESTATES, TRACT 4152, BEING A SUBDIVISION OF THE N~ OF THE SW\, SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held June 6, 1994, a public hearing was conducted to determine whether approval should be granted for the Preliminary Subdivision plan and Petition of Exception for Desert Lakes Estates, Tract 4152, and WHEREAS, the owner/developer of this tract is Desert Lakes Development, L.P. and Sage Investment Inc., Angelo Rinaldi, P.o. Box 8858, Fort Mohave, Arizona. The engineer/surveyor responsible for the preparation of the drainage report and design of this subdivision is Stadler Consulting Engineers, phoenix, Arizona, and WHEREAS, this Mountain View Road east of SR 95, and property is located on the east side of one-half mile south of Joy Lane and one mile WHEREAS, the Preliminary Plan depicts 80.46 acres subdivided into 272 single family residential lots and 14 drainage parcels. The residential lots range in size from 8,000 to 9,260 square feet which provides a density of 3.38 lots per acre, and WHEREAS, the developer intends that water will be provided by Bermuda Water Company, sewer service by Sorenson Sanitary District, electric power by Mohave Electric, gas by Southwest Gas and telephone by Citizens Utilities. Solid waste will be collected by Tri-State Refuse Disposal and transported to the Mohave County Landfill. Fort Mohave Mesa Fire Department will furnish fire protection for this subdivision, and WHEREAS, a Petition of Exception request is submitted as follows: RESOLUTION NO. 94-170 Page 2 . . 1. The development is proposing 10-foot public utility easements (PUEs) along the fronts and sides of all lots adjacent to street rights-of-way. Section 6,9-1 of the Subdivision Regulations requires a minimum l6-foot wide PUE be provided along the rear lot lines. 2. Blocks A and I are longer than the 1320 feet allowed in Section 6.6-lA of the Subdivision Regulations, and WHEREAS, this petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of exceptions from the subdivision regulations as outlined in Article 1.13, for the following reasons: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because the proposed Desert Lakes Estates development does not restrict usage or access to any adjacent properties. 2. This request will not nullify the intent or purpose of the Master Plan of the County or other regulations because the proposed exceptions do not change the intended land use nor do they impact adj acent properties in any way as to limit their use. 3. The special circumstances or conditions affecting the proposed development are as follows: a. Access through the long block, Block A, is not possible due to the existing lot configuration of the Desert Lakes Golf Course and Estates subdivision to the south. b. The existence of the gas pipeline easement and the desire to limit the roadway crossings of the easement resulted in the excess length of Block I. c. The electric, telephone, gas and CATV utilities serving ,the Desert Lakes Estates subdivision will be underground. RESOLUTION NO. 94-170 Page 3 WHEREAS, at a public hearing on May 11, 1994, the Mohave County Planning and Zoning Commission recommended APPROVAL of the requested Preliminary Subdivision Plan and Petition of Exceptions subject to the following: . Improve Mountain View Road along the entire west side of this subdivision with the first phase of this project. . Improvements will include the proposed drainage channel along Mountain View Road to its outlet at the southwest corner of the project. . The matching half width (north 35-foot) right-of-way for Everglades Boulevard shall be obtained, dedicated and improved (paved) prior to or in conjunction with the recordation of the Final Plat for Phases "F-H". . The developer shall widen the Joy Lane intersection with the development of the first phase (ADOT has issued the permit) and add a third lane which will provide for right and left turn lanes. . All streets within the subdivision and access to the nearest paved roads shall be constructed and paved with asphaltic concrete in accordance with Standard Specifications Nos. 171 and lOl.lOA or better. . The streets will include curb and gutter as specified in BaS Resolution No, 91-335. . The owner/subdivider shall install a water distribution system to serve each lot wi thin the subdivision. . Fire hydrants shall be provided the requirements of the Fort Department. in accordance with Mohave Mesa Fire . Drainage related improvements will be made as recommended by the project engineer in the county approved drainage report. . Agreements will be made to extend underground electric, telephone and water service to each lot in accordance wi th Arizona Corporation Commission Regulations. These service agreements will be submitted prior to final recordation. . The sewer and waterline extensions shall be approved by the Arizona Department of Environmental Quality. . RESOLUTION NO. 94-170 Page 5 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona on May 22, 1994, as required by the Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 6, 1994, APPROVED the Preliminary Subdivision Plan and Petition of Exceptions for Desert Lakes Estates, Tract 4152, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
