RESOLUTION NO. 94-151
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF
SECTION 1, TOWNSHIP 14 NORTH, RANGE 17 WEST IN AN A-R/36A
(AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE
FOR THE ESTABLISHMENT OF A FIBER OPTIC REGENERATION BUILDING IN
THE MOHAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 2, 1994, a public hearing was
conducted to determine whether approval should be granted for a
zoning Use Permit for the above described property to applicant
Marvin Middle of power Environmental Services, Inc. of Hailey,
Idaho, and

WHEREAS, the proposed site is located along the El Paso
Natural Gas Line south of Yucca. The site is accessed by 1-40
via the Gem Acres Interchange, then south to the El Paso pipeline
easement, then southeast approximately 17 miles to the proposed
site, and

WHEREAS, a fiber optic line is being constructed through the
county and the regeneration building is needed to boost the power
to the optic lines, and
WHEREAS, there is a natural gas pumping station to the
south. The remainder of the area is vacant. A gravel pad has
been built on the site where the building will be placed. The
building will be prefabricated and then installed on the site,
and
WHEREAS, power for the site will be provided by an on-site
generator, with a 500-gallon fuel storage tank, and
WHEREAS, review of Floodplain Map #040058-3025B indicates
this parcel to be in Zones A and D. The portion in zone A is an
area of lOO-year flood, base flood elevations and flood hazard
factors not determined. The remainder of the parcel is in zone
D, areas of undetermined but possible flood hazards. Note:

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning CommissiOn on April 13, 1994, the commission
recommended APPROVAL for a Zoning Use Permit subj ect to the
following:

1. The applicant comply with all applicable provisions of
the Mohave County zoning Regulations.
2. That appropriate zoning, building, environmental and
floodplain permits be obtained.
3. If construction or use has not commenced wi thin one
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six months, then
approval shall terminate at that date.
4. This zoning Use Permit is subject to revocation upon 60
days notification by the Board of Supervisors if, in.
the opinion of the Commission and Board, the continued
use of the property would be contrary to the public
health, safety, and welfare.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, April 17, 1994, and posted April 15,
1994, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, May 2, 1994, APPROVED this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning commission and outlined herein.
