RESOLUTION NO. 94-149
A RESOLUTION SETTING FORTH A REZONE OF THE SW~, SW~ OF LOT 1, SO-
HI ESTATES, UNIT 2, SECTION 31, TOWNSHIP 22 NORTH, RANGE 17 WEST
FROM R-E (RESIDENTIAL RECREATION) TO C-2H (GENERAL
COMMERCIAL/HIGHWAY FRONTAGE) IN THE GOLDEN VALLEY AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County Board
of Supervisors held on June 20, 1994, a public hearing was
conducted to determine whether approval should be granted for a
Rezone for the above described property to owner Don Scott of
Kingman, Arizona, and
WHEREAS, the property is located approximately four miles
north of the Highway 93 and 68 junction and east of Highway 93.
The property is accessed from Highway 93 by Chea Drive, then east
to Sunset Drive, then north on Sunset Road to the property. The
property can also be accessed from Highway 93 by Ranch Road, then
east to the property proposed for rezoning, and
WHEREAS, the surrounding land uses consist of single family
homes to the north and east and vacant land to the west and
south. The property proposed for rezoning and the surrounding
properties are zoned R-E (Residential-Recreation), and
WHEREAS, there are a number of lots zoned commercial located
in So-Hi Estates, Unit 3 about one-half mile south of this site,
and
WHEREAS, there is a residential home and garage located on
the site. The garage is being used by the owner as a commercial
auto repair shop. The applicant is requesting this rezoning to
have the required zoning for an auto repair shop, and
WHEREAS, the Mohave County Zoning Department has cited the
owner with operating a commercial business in an unauthorized
zone, and has received several complaints from adjacent property
owners regarding this continuing violation, and
WHEREAS, review of Floodplain Map #040058-2150C indicates
this parcel is located in Zone C, an area of minimal flooding,

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on April 13, 1994, the Commission
recommended DENIAL for a rezone based on the following:

2. This rezone would constitute a spot zone.
3. There is already a commercial node established in this
area with the majority of the properties undeveloped.
4. Mohave County Zoning Ordinance, Section 21.1A2,
requires that the property front on a state highway,
county-defined arterial highway, or a frontage road
paralleling and contiguous to any of these. The
subject property does not meet this criteria.
5. The Mohave County zoning Department has received
several complaints from adjacent property owners
regarding this continuing violation.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their special meeting on Monday, June 20, 1994, DENIED this
rezone as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
