RESOLUTION NO. 94-142
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE LOT LINE BETWEEN
LOTS 59 AND 60 AND ALL OTHER LOT LINES WITHIN LOTS 59 AND 60 IN
BERMUDA PLANTATIONS, SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST
IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 2, 1994, a public hearing waS
conducted to determine whether approval should be granted for an
abandonment of the above described property to owner Donald
Kelley of Bermuda City, Arizona, and
WHEREAS, the property is located east of the Needles Bridge
and Highway 95 (Harbor Avenue), and south of Levee Drive. The
property can be accessed from Highway 95 (Harbor Drive) by Levee
Drive or Dike Road east to the site, and
WHEREAS, the surrounding land uses consist of residential
homes and vacant land, and
WHEREAS, there are a number of homes and buildings on the
site, with the homes located between the Colorado River and Dike
Road, and
WHEREAS, the lots located in Bermuda Plantations are long
and narrow and run from Levee Drive to the ColoradO River, and
WHEREAS, the lots located in Bermuda Plantations are zoned
R-E (Residential-Recreation) which permits guest houses with a
20,000 square foot minimum lot size. The lots were originally
created at one-acre-plus. Many of these lots have been divided
into two lots, with a primary residence and guest home on each
lot, and
WHEREAS, the applicant owns two Bermuda Plantations lots and
proposes to abandon the lot line between Lots 59 and 60 running
north to south, and creating new lot lines that will create three
parcels with lot lines running east to west, and
WHEREAS, the new lot configuration will be better suited to
the locations of the existing homes on the property, and
WHEREAS, at the public hearing before the
Planning and Zoning Commission on April 13, 1994,
recommended APPROVAL for an abandonment subject to
Mohave County

WHEREAS, review of Floodplain Map #040058-26l5C indicates
this parcel to be in Zones A and B. The portion in Zone A is an
area of 100-year flood; base flood elevations and flood hazard
factors not determined. The remainder of the parcel is in Zone
8, areas between limits of the 100-year flood and SOD-year flood.
This parcel requires a Floodplain Use Permit for any development,
and
1. That the original lot line between Lots 59 and 60 and
all other lot 1 ines wi thin Lots 59 and 60 of Bermuda
Plantations be abandoned.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, April 17, 1994, and posted April 15,
1994, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations,

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, May 2, 1994, APPROVED this
abandonment as recommended by the Mohave County Planning and
zoning Commission and outlined herein.
