RESOLUTION NO. 94-133
A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR
THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR PALM ESTATES II,
TRACT 4104, AND AN EXTENSION OF TIME FOR THE ABANDONMENT OF
ROADWAYS AND EASEMENTS AND THE ABANDONMENT-REVERSION TO ACREAGE
FOR PORTIONS OF RIO HACIENDAS, TRACT 1224, BEING A PORTION OF
SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE
SOUTH MOHAVE VALLEY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held May 2, 1994, a public hearing was conducted
to determine whether approval should be granted for an Extension
of Time for the approved preliminary Subdivision Plan of Palm
Estates II, Tract 4104, and
WHEREAS, the owner/developer of this tract is Harold Sharp,
Sharp Investment Company of Bullhead City, Arizona. The engineer
responsible for the preparation of the drainage report and design
of this subdivision is Stovall Engineers Inc., Mohave Valley,
Arizona, and
WHEREAS, the plan as submi tted and reviewed is a
resubdivision of 27 acres subdivided into 82 lots. The minimum
lot size is 7,800 square feet and the maximum lot size is 13,000
square feet. The overall project density is 3,5 lots per acre,
and
WHEREAS, Article 3.10-1 states "Upon application to the
Commission and prior to the expiration of the time limit,
extensions in increments of one (1) year may be granted by the
Board if the subdivider is actively processing the final plat.
If such action is not taken then all proceedings relating to the
plat shall be terminated", and
WHEREAS, in a letter dated February 25, 1994, Kelly Grier,
Stovall Engineers, speaking on behalf of the owner/developer,
states: "On behalf of the Owner/Developer of Palm Estates, Tract
4104, I respectfully request an Extension of Time for the
approved Preliminary Plan in order to proceed with the processing
of the next phase, Tract 4104-8 of this project (Tract 4104-A has
been recorded), An Extension of Time is also requested for the
approval of the Abandonment of roadways and portions Of Rio
Hacienda, Tract 1224. We anticipate the submittal of the Final
Plat of Phase 8, for County review and processing, within the
next few months, and recordation within the time constraints of
this requested Extension of Time,

"This is the fourth request for an Extension of time on this
project. A cheque, made payable to Mohave County Planning
and Zoning Department, in the amount of $300.00, is enclosed
as application fee.", and
WHEREAS, the preliminary plan for this tract was approved by
the Mohave County Board of Supervisors on April 2, 1990, via BOS
Resolution No. 90~80. A condition of the preliminary plan
approval was the abandonment of a portion of Rio Hacienda, Tract
1224, and
WHEREAS, the abandonments for roadways and easements was
approved via Resolution No. 90-313 on November 5, 1990, The
abandonment/reversion to acreage was approved via Resolution No.
90~312 on November 5, 1990, A condition of approval for the
abandonments was that the final plat for Palm Estates II, Tract
4104-A, be recorded within one year or the abandoned portions
would revert to their previous condition, and

WHEREAS, the first Extension of Time was granted via BOS
Resolution No. 91-292 on November 4, 1991. The second Extension
of Time was granted via BOS Resolution No. 92-108 on April 6,
1992. The third Extension of Time was granted via BOS Resolution
No. 93-83 on April 5, 1993. This will be the fourth Extension of
Time, and
WHEREAS, at a public hearing on April 13, 1994, the Mohave
County Planning and Zoning Commission recommended APPROVAL of the
requested Extension of Time with the applicant understanding and
accepting the following conditions:
1. Compliance with all conditions of BOS Resolution No.
90-80.
2. This Extension of Time will be in effect until April 2,
1995.
WHEREAS, notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation, in Kingman,
Mohave County, Arizona on April 17, 1994, as required by the
Arizona Revised Statutes and the Mohave County Zoning
Regulations.
