PAG~ i OF J HOHAV~ COUNTY BOARD OF SUPERVISORS RtCDRPtN& FEE 0,00 HC RESOLUTION NO. 94-131 A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF MISSION PARK RANCH, TRACT 4072, BEING A PORTION OF THE W!.; OF THE NE\ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held May 2, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Subdivision Plan of Mission Park Ranch, Tract 4072, and WHEREAS, the owners/developers of this tract are Laurence S. Brody and Nathan Ostrin (Ostrin Family Trust) of Torrance. California. The engineer responsible for the preparation of the drainage report and design of this Subdivision is Stovall Engineers, Inc" Mohave Valley, Arizona, and WHEREAS, the plan as submitted and reviewed is a resubdivision of 75 acres subdivided into 261 lots, The minimum lot size is 8,050 square feet, and the maximum lot size is 18,560 square feet. The overall project density is 3.5 lots per acre, and WHEREAS, Article III, Section 3.10, states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the Subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, in a letter dated February 5, 1994, Ms. G. Kelly Grier, Stovall Engineers, Inc., states: "On April 5, 1993, the Board of Supervisors approved the fifth Extension of Time for Mission Park Ranchos, Tract 4072, (P&Z Note: This is incorrect; it was actually the fourth.) This extension will expire on April 4, 1994. On behalf of the ownerS/developers, Mr. Laurence S. Brody and Mr. Nathan Ostrin (for the Ostrin Family Trust), I respectfUlly request an additional one year Extension of Time for the approval of this Preliminary Plan, . . Th:is proposed subd:iv:is:ion was previously under ownership by a developer who defaulted on the financ:ing. The original owners, who are now in control of the property, took back the property just over one year ago. At the time of the last Extension of Time, the new owners had just pa:id all back property taxes owing, and had water rights transferred. They had hoped to cont:inue the processing of the project by now, but have been unable to do so due to the econom:ic downturn. "The developers are, now, actively pursuing financing for completion of this project, and are considering the possibility of revision of the original plan for wastewater disposal from individual septic system, to community sewer system. Their plans will require a further Extension of Time in order to continue the submittal process, and we ask that you will support their efforts.", and -..:.... WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of Supervisors on April 4, 1988, via P&ZC Resolution 88-27. The applicant requested an Extension of Time in February, 1990. The Extension of Time was granted via Resolution No. 90-41, and expired December, 1990. The oorrect expiration date should have been April 4, 1991. The second Extension of Time was granted via Resolution No. 91-120 and expired April 4, 1992. The third Extension of Time was granted via Resolution No. 92-106 and expired April 4, 1993. The fourth Extension of Time was granted via Resolution No. 93-81 and expires April 4, 1994. This will be the fifth Extension of Time, and ::::':~ /."....' i'-" .~ WHEREAS, at a public hearing on April 13, 1994, the Mohave County Planning and Zoning Commission recommended APPROVAL of the requested Extension of Time subject to the following conditions: 1. Compliance with all conditions of BOS ReSOlution No. 88-27. 2. RESOLUTION NO. 94-131 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 2, 1994, APPROVED the Extension of Time for Mission Park Ranch, Tract 4072, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
