RESOLUTION NO. 94-117 A RESOLUTION SETTING FORTH AN ABANDONMENT OF A IS-FOOT ROADWAY AND PUBLIC UTILITY EASEMENT ON THE EAST SIDE OF PARCEL 34-9 AND A l5-FOOT ROADWAY AND PUBLIC UTILITY EASEMENT ON THE WEST SIDE OF PARCEL 34-10 IN SECTION 34, TOWNSHIP 21 NORTH, RANGE 14 WEST IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held .on April 4, 1994, a public hearing waS conducted to determine whether approval should be granted for an abandonment of the above described property to owners William and Phyllis Williams of Kingman, Arizona, and WHEREAS, the proposed roadway and PUE to be abandoned is located two and one-half miles east of Blake Ranch Road and south of 1-40. The proposed abandonment is accessed from 1-40 via Blake Ranch Road south to Dubois Road, then east to Roy Road, then south to the mid-section line of Section 34, then east to the proposed roadway and PUE proposed for abandonment, and WHEREAS, the land uses in the area consist of scattered residential dwellings on large acre parcels and vacant land, and WHEREAS, the area has been divided into 40-acre parcels with IS-foot roadway and Public Utility Easements (PUEs) on the exterior of the parcels. Only a few of these easements have been improved and are being used for roadway purposes with the remainder in their natural state. The majority of the roadways providing access for those living in the area run east and west. The easement proposed for abando~ent is one of the easements that has not been improved and remains in a natural state,. and WHEREAS, the proposed easement runs north to south dividing Parcels 34-9 and 34-10. The applicant owns the east half of Parcel 34-9 and the west half of 34-10. This easement divides the applicant's parcel into' two pieces. The owner would like to have this easement abandoned so no roadway will be built through the easement, and WHEREAS, the power company se~vicing this parcel has indicated that they are not opposed to the abandonment of this easement for roadway purposes but do object to the abandonment of the PUE, and ~ . . . PAGE 2 OF 2 BK 2383 PG 481 (FEE:94-20~33) RESOLUTION NO. 94-117 Page 2 WHEREAS, review of Floodplain Map #040058-23758 indicates this parcel is located in Zone C. an area of minimal flooding, and WHEREAS, at the public hearing before the MOhave County Planning and Zoning Commission on March 16, 1994, the Commission recommended APPROVAL for a re2;One subject to the following: 1. That the IS-foot roadway on the east side of Parcel 34- 9 and the IS-foot roadway on the west side of Parcel 34-10 in Section 34. Township 21 North, Range 14 West be abandoned. 2. That the IS-foot PUE on the east side of Parcel 34-9 and the IS-foot PUE on the west side of Parcel 34-10 in Section 34, Township 21 North, Range 14 West remain. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, MOhave County, Arizona, March 20, 1994, and posted March 18, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the 80ard of Supervisors, at their regular meeting on Monday, April 4, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning CommiSSion and outlined herein.
