"'"I' RESOLUTION NO. 94-114 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 49, LAZY Y-U RANCH PHASE I, SECTION 10, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A- R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/15A, A-R/8A AND A-R/7A (AGRICULTURAL- RESIDENTIAL/FIFTEEN, EIGHT AND SEVEN ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE HUALAPAI MOUNTAIN PORTION OF THE MO!tAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 4, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone of the above described property to owners Michael and Tammie Wauhob of Hesperia, California, and WHEREAS, the property is .located approximately three and one-half miles southeast of the Kingman city limits. This land is accessed via Hualapai Mountain Road to Lazy Y-U Drive, then southwest to TOmahawk Drive and southwest to the property, and WHEREAS, there are several widely scattered residences to the north and east of this area. No utilities have yet been extended to the southwest portion of Lazy Y-U Ranch, Phase I, and WHEREAS, the site is vacant and i;> located in mountainous terrain. The proposed western and southeast parcels contain steep hills, sloping down to a ravine and wash in the northeast parcel. The most suitable building sites appear to be near the intersection of Tomahawk Drive, Ranch House Drive and Branding Iron Lane, and WHEREAS, review of Floodplain Map #040058-2350C indicates that the property is within Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 16, 1994, the Commission recommended APPROVAL for a rezone subject to the following: 1. The northeast parcel be zoned A-R/8A (Agricul tural- Residential/Eight Acre Minimum Lot Size); the southeast parcel be zoned A-R/7A (Agricultural-Residential/seven Acre Minimum Lot Size); and the western parcel be zoned A-R/15A (Agricultural-Residential/Fifteen Acre Minimum Lot Size). . . Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. The parcels will meet or exceed their respective acreages exclusive of roadways. 4. Each parcel shall have legal aCcess. 5. The parcel plat shall show any surface drainage and FEMA flood zones. 6. Roadway easement centerlines will be monumented beneath the bladed road surface at all easement angle points and coinciding parcel corners. 7. That appropriate zoning, building, environmental and floodplain permits be Obtained prior to any development. These permits will not be issued until parcel plat recordation. 8. The rezone Shall not become effective for 30 days after final Board of Supervisors' approval for the change in classification, as per ARS 11-829E. 9. If these conditions are not met wi thin one year this approval will be void. If at the expiration of this period the property has not been improved to meet the uSe for which it was conditionally approved, the Board (after notification by registe!Ced mail to the owner and applicant who requested the rezoning) shall SChedule a publiC hearing to grant an extension, determine compliance with the SChedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statute's Annotated, Title ll, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March .20, 1994, and posted March 18, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . RESOLUTION NO. 94-ll4 Page 3 PAGE 3 OF 3 BK 2383 PG 474 (rEE~94-20530) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 4, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
