A R~SOLUTION SETTING FORTH A REZONE OF A PORTION OF THE N~ OF LOT
259, SECTION 11, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM A-R/lOA
(AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE AND C2-
H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) TO C-MO (COMMERCIAL
MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE GOLDEN VALLEY AREA,
MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave county Board
of Supervisors held on April 4, 1994, a public hearing was
conducted to determine whether approval should be granted for a
rezone on the above described property, and
WHEREAS, this item is two-fold: a "corrective zoning
action" and requested rezones by land owners. It waS originally
heard by the Commission on December 8, 1993. At a special
meeting on January 17, 1994, the Board of Supervisors referred
this rezone back to the Planning and zoning Commission for
further consideration, and
WHEREAS, the property is located south of Highway 68 and
eight and one-half miles west of the intersection of Highways 68
and 93. The parcel can be accessed directly from Highway 68, and
WHEREAS, land uses adjacent to .the property consist of
residential homes to the east and west, a gravel pit and vacant
land to the south. The surrounding area is primarily vacant with
a residential subdivision to the north and a commercial business
to the west, and
WHEREAS, there is a warehouse building on the northern
portion of the site. The newspaper printing plant on the
southern portion is accessed via a 30-foot private roadway
easement on the east side of the property, and
WHEREAS, the area is located within the Urban/Building
Overlay Zone and the Golden/Sacramento Valley Area Plan, and
WHEREAS, the history regarding this item is complex. On or
about January 14, 1989, the Planning and Zoning Department
received an application for a rezoning of a portion of the N~ of
Lot 259, Section 11, Township 21 North, Range 19 West. Due to a
series of errors, the area actually rezoned by the Board of
Supervisors was Assessor's Parcel Number lIB (current Assessor's
Parcel Numbers are 11M and I1J). These actions created several
inaccuracies that need to be corrected:

1. The area the applicant requested be rezoned, which was
to be where the newspaper plant now sits, ,"as not what
was rezoned. The parcel directly to the west was
rezoned.

Minimum Lot Size) lots that are not five acres in size:
one CM/12.5A (Commercial Manufacturing/Twelve and One-
Half Acre Minimum Lot Size) that is not 12.5 acres and
the remaining A-R/I0A (Agricultural-Residential/Ten
Acre Minimum Lot Size) parcel does not meet the ten-
acre minimum.
WHEREAS, in October of 1993, Mr. Gritman, "NEW OWNER" of
Parcel llP, requested a rezOne from C2-H/5A (Highway
Commercial/Five Acre Minimum Lot Size) to CMO (Co~nercial
Manufacturing Open Lot Storage). Part of .this parcel would have
had C2-H/5A (Highway Commercial/Five Acre Minimum Lot Size) and
C-M (Commercial Manufacturing) if the original rezone had been
done correctly. The purpose of this request is to accommodate a
vehicle repair business with an impound yard and an RV and boat
storage area, and
WHEREAS, several weeks later Mr. Joseph soldwedel requested
a zone change from CM/12.5 (Commercial Manufacturing/Twelve and
One-Half Acre Minimum Lot Size) and C2H/5A (Highway
Commercial/Five Acre Minimum Lot Size) to CM (Commercial
Manufacturing) and C2H/5A (Highway CommerCial/Five Acre Minimum
Lot Size). The requested rezone is to clear the problems with
the acreage sizes and rezone that portion which was the subject
of the original rezone, and
WHEREAS, because of the errors that were committed in the
past, the requests for new zone changes by the current owners and
current land uses established by recent rezones, staff felt that
it would be proper to correct everything in one readj usting
action in lieu of several actions, and
WHEREAS, the rezoning of the north half of Lot 259 to CMO
(Commercial Manufacturing Open Lot Storage) would accommodate the
land owner's needs and correct the errors. The only difference
between CM (Commercial Manufacturing) and CMO (Commercial
Manufacturing Open Lot "Storage) is the latter allows for a night
watchman's quarters and open lot storage. If this rezone is
approved as CMO (Commercial Manufacturing Open Lot Storage)
wi thout an acreage designation then the possibli ty of further
splitting of these parcels may occur, and

WHEREAS, Mr. John McCulloch of Phoenix, current owner of the
remaining parcels involved in the above referenced proposed
rezone, stated in a telephone conversation with Tom Aragon,
Zoning Manager, that he had no problem with the rezoning of his
parcels, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on March 16, 1994, the Commission
recommended APPROVAL for a rezone subject to the following:
1. That Tax Assessor's Parcels llL, 11N, liP be zoned C-
MO/3A (Commercial Manufacturing-Open Lot Storage/Three
Acre Minimum Lot Size), and Tax Assessor's Parcels 11C,
liD, IlJ be zoned C-MO/IA (Commercial Manufacturing-
Open Lot Storage/One Acre Minimum Lot Size) and Tax
AsseSSOr's Parcel 11M be zoned C-MO/20M (Commercial
Manufacturing-Open Lot Storage/Twenty Thousand Square
Foot Minimum Lot Size). All Tax Assessor's Parcels
referenced are based on Tax AssessOr's Map, Book 306,
Map 48, dated November 16, 1993.
2. That appropriate zoning, building, environmental. and
floodplain permits be obtained.
3. The applicant comply with all applicable provisions of
the Mohave County Zoning Regulations.
4. The rezone shall not become effective. until 30 days
after final approval of the change in classification by
the Board of Supervisors, as per ARS ll-829E.
5. That all open lot storage be enclosed by a view
obscuring fence.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, March 20, 1994, and posted March 18,
1994, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, April 4, 1994, APPROVED this
rezone as recommended by the Mohave County Planning and Zoning
Commission utlined herein.
