".., ..,'",',., , '..,~~>~" RESOLUTION NO. 94-112 A RESOLUTION SETTING FORTH A REZONE OF THAT PORTION OF PARCEL 18 NORTH OF 1iWY. 68, SECTION 7, TOWNSHIP 21 NORTH, RANGE 18 WEST FROM A-R (AGRICULTURAL-RESIDENTIAL) TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 4, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners Donald Kopczick and Patricia 8rown of, Glendale, California, and WHEREAS, the property is located six miles west of the Highway 68 and 93 intersection on the north side of Highway 68. The property has frontage on Highway 68 and is accessed from Highway 68 via Colorado Road, and WHEREAS, the surrounding land uses consist of scattered homes and vacant land. The site is also vacant, and WHEREAS, the owner is requesting C-2H zoning for the entire parcel. The Planning and Zoning staff is recommending that the southern 200 feet adjacent to Highway 68 be zoned C-2H and the northern portion be zoned C-2. The O'oIner' S representative has been notified of this change and concurs with staff's recommendation, and WHEREAS, the owner proposes to divide the parcel into two one-acre parcels and one six~plus-acre parcel. The two northeastern one-acre parcels are proposed for C-2/lA :z;oning. The other portion of the property will remain as one parcel but will have two proposed zoning designations, with the south 200 feet proposed for C-2H and the northwestern portion proposed for C-2 zoning, and WHEREAS, review of Floodplain Map #040058-23258 this parcel is located in Zone C, an area of minimal and indicates flooding, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 16, 1994, the Commission recommended APPROVAL for a re:z;onesubject to the following: RESOLUTION NO. 94-112 Page 2 ~ . The northeastern parcels be zoned ~2_Ll.6_ (General- Commercial/One Acre Minimum Lot Size); the northwestern parcel be zoned C-2/3A (General-Commercial/Three Acre ~- Minimum Lot Size); and the southern 300 feet be zoned C-2H/2A (General-Commercial H:;:.gh~ay Frontage/'I'wQ"A'1;:re Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications. 3. That the Board of Supervisors accept the dedication of a lOO-foot roadway along the south boundary, a 30-foot roadway dedication along the east and west boundaries, a 20-foot roadway dedication along the north boundary, and 20-foot radius curves at each corner of the property. In addition. the granting of an 8-foot PUE around the perimeter of the property. The dedication and granting required by the rezoning resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon parcel Plat recordation. 4. The parcels will meet Or exceed their respective acreage exclusive of road easements. 5. Each parcel shall have legal aCcess. 6. The Parcel Plat shall show any surface drainage and FEMA flood zones. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The reZone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. 9. I f these conditions are not met wi thin one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for Which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the SChedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. I I I I I I I ! I . I '! i j I' ~ . \ . . RESOLUTION NO. 94-112 PAGE 3 OF 3 BK 2383 PG 468 (FEE~94-2Q528) Page 3 Wl!EREAS, the notice of hearing waS published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 20, 1994, and posted March 18, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of supervisors, at their regular meeting on Monday, April 4, 1994, APPROVED this rezone as recoounended by the Mohave County Planning and Zoning Commission and outlined herein.
