A RESOLUTION SETTING FORTH A REZONE OF THE S~ OF LOT 6, BLOCK B,
FORT MORAVE MESA RANCHOS, SECTION 26, TOWNSHIP 19 NORTH, RANGE 22
WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) TO R-E (RESIDENTIAL-
RECREATION) IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 6, 1994, a publio hearing was
conducted to determine whether approval should be granted for a
rezone for the above described property to owners Thomas and
Maria Messmer of Mohave Valley, Arizona, and
WHEREAS, Fort Mohave Mesa Ranchos is located two and
half miles south of Bullhead City and east of Highway 95.

WHEREAS, the surrounding area oonsists of single family
homes and vacant land, and
WHEREAS, the typical lot size mlnlmum for this area is one
acre or greater, with the majority of the lots in the area one or
two acres. There are a few lots belOW the one-acre minimum, and
WHEREAS, the purpose of this request is to allow a second
home on the lot. The owner has indicated that they would like to
divide the property in half to permit the second home, and
WHEREAS, this rezone was denied by the Planning and Zoning
Commission at their meeting of March 16, 1994. The request was
then presented to the Board of Supervisors on April 4, 1994. At
the public hearing the Board discussed pOSSible approval of the
rezoning. Before the Board considered any action on the item the
proposal was sent back to the Commission for additional review,
and
WHEREAS, the area is zoned A-R which allows one dwelling
unit per one acre of land. R-E zoning would permit one main
dwelling unit and one guest quarter. If the property were
rezoned R-E the lot could be divided three times, creating the
possibility of having six dwelling units on the site. The rezone
may set a preoedence for other lots to be rezoned to R-E with the
potential of greatly increasing the density of the area with two
dwelling units on each 20,000 square foot site, and

WHEREAS, with the adoption of the secondary residence
ordinance, secondary residences will be permitted in A-R zones.
This type of zoning designation will be similar to R-E zoning
except for the minimum lot size requirement, and

WHEREAS, a second option for this rezone would be to have
the owners divide the lot without rezoning the property. Should
the owner divide the property without a rezone, a public water
source and an access easement would be required before building
permits would be issued. This option would create two lots, one
of which would be a flag lot. In this case, one lot would remain
an acre and one lot would be below the one-acre minimum lot size
for A-R zoning. This option would then raise the question of
what size minimum below One acre would be permitted, and

WHEREAS, a third option would be to set a minimum lot size
on the R-E zoning request. Specifying a lot size minimum of
30,000 square feet would allow the property to be divided into
two lots only. This option would require a resolution that would
permit conditions to be placed on the rezoning, and
WHEREAS, staff believes that specifying a 30,000 square foot
lot size minimum would be the best option of approval, and
WHEREAS, review of Floodplain Map #040058-2445C indicates
this parcel to be in Zone AO, an area of lOO-year shallOW
flooding where depths are between one and three feet. Base flood
elevations are shown, but no flood hazard factors are determined.
A Floodplain Use Permit is required for development, and
WHEREAS, the Planning and Zoning staff recommended approval
of the proposed rezoning based on the third option by setting a
minimum lot size that would permit the property to be divided
into two parcels. Staff's recommendation was to rezone the
property to R-E/30M (Residential-Recreation/Thirty Thousand
Square Foot Minimum Lot Size) with the following conditions:
that the parcels be zoned R-E/30M (Residential-Recreation/Thirty
Thousand Square Foot Minimum Lot Size); the submittal and
recordation of a Parcel Plat prepared in accordance with Article
3.16 Of the Mohave County Subdivision Regulations and l02.04-B of
the Standard Specifications; that the Board of Supervisors accept
the granting of a 30-foot ingress/egress easement along the south
side of the western lot; and the property must be served by a
public franchise water company before the issuance of any
building permits, and

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 11, 1994, the Commission
recommended DENIAL for a rezone based on the following:
l. The rezone may set a precedence for other lots to be
rezoned to R-E with the potential of greatly increasing
the density of the area with two dwelling units on each
site.
2. The Planning and Zoning Commission voted in favor of
the second option for this rezone which was to have the
owners divide the lot without rezoning the property.
Division of the property without a rezone would require
a public water source and access. This option would
create two lots, one of which would be a flag lot. In
this case, one lot would remain one acre and one lot
would be below the one-acre minimum lot size for A-R
zoning.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, May 22, 1994, and posted May 20, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 6, 1994, DENIED this
rezone as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
