RESOLUTION NO. 94-94
A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR
THE APPROVED PRELIMINARY SUBDIVISION PLAN OF FAIRWAY ESTATES,
TRACT 4097, BEING A PORTION OF SECTION 35, TOWNSHIP 19 NORTH,
RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, HOHAVE
COUNTY, ARIZONA.
WHEREAS. at the regular meeting of the Mohave County Board
of Supervisors held April 4, 1994. a public hearing was conducted
to determine whether approval should be granted for an Extension
of Time for the approved Preliminary SubdiVision Plan of Fairway
Estates, Tract 4097, and
WHEREAS, the owners/developers of this tract are Glen L, and
Pearle A. Ludwig, San Bernardino, California. The engineer of
record on this project is Richard J. Rieker, P. E. of Ludwig
Engineering, San Bernardino, California, and
WHEREAS, the proposed subdivision is located in the Fort
Mohave area. approximately three miles south of Bullhead City on
Highway 95 and one-half mile east of Highway 95 on Joy Lane at
the southwest corner of the intersection of Joy Lane and Mountain
View Road, and
WHEREAS, the Preliminary Plan depiots approximately 65 acres
subdivided into 278 residential lots, plus a 15-aore parcel which
may be utilized as either Multi-family or Neighborhood
Commercial, and
WHEREAS, the water will be supplied by Bermuda Water
Company, electric po~er by Mohave Electric Cooperative, and
telephone service by Citizens Utilities Company. Sewage
disposal will be provided by Sorenson Utility Company, Inc. Fort
Mohave Mesa Fire Department will be providing fire protection for
this project, and private carrier will be providing the solid
waste (garbage) disposal to Mohave'Valley Landfill, and
WHEREAS, Article 3.10 states: "Upon application to the
Commission and prior to the expiration of the time limit,
extensions in increments of one year may be granted by the Board
if the subdivider is actively processing the Final Plat. If such
action is not taken then all proceedings relating to the plat
shall be terminated", and .

WHEREAS, in a letter dated January l2, 1994, received by
Planning and Zoning on January 14, 1994, ML Richard J. Rieker,
P. E., representative of the owner (developer, states: "According
to my records. the Preliminary Plan for the referenced
subdivision will expire on February 5. 1994. Therefore. please
consider this our application to request an extension of time.
Enclosed is a check in the amount of $300.00 to process the
extension for the Preliminary Plan for Fairway Es tates. Tract
4097.

"Since 1990, four phases of Fairway Estates have been
recorded and subdiVision improvements completed. All
offsite improvements have been completed for the entire
project including the clubhouse recreational complex. There
are three phases remaining to be recorded; Tracts 4097C,
4097D. and 4097E. On June 15. 1992, the Board of
Supervisors conditionally approved the Final plats for the
remaining phases but recording wasn't pursued because
sufficient inventory was available. TO date. 46 houses have
been completed with two currently under construction.

"Fairway Estates is a planned residential community offering
completed houses for sale. Since the average rate of sales
is approximately 3 houses per month and the available
inventory is 156 lots. it will be some time before there is
a need.

WHEREAS. the Preliminary Subdivision Plan was approved by
the Mohave County Board of Supervisors on February 5, 1990, via
Resolution No. 90-35. On February 3, 1992, a first Extension of
Time waS granted by the Mohave County Board of Supervisors via
Resolution No. 92-32. The second Extension of T1me was granted
via BOS Resolution No. 93-275. This will be the third Extension
of Time, and
WHEREAS, at a public hearing on March 16, 1994, the Mohave
County Planning and Zoning Commission recommended Approval of the
requested Extension of Time subject to the following:

1. Compliance with all conditions as stated in 80S
Resolution No. 90-35.
2. This Extension of Time will be in effect until February
5. 1995.
WHEREAS, the notice of hearing was publ~shed in the Kingman
Daily Miner, a newspaper of general circulation, in Kingman,
Mohave County, Arizona on March 20, 1994, as required by the
Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, April 4, 1994, APPROVED the
Extension of Time for Fairway Estates, Tract 4097, as recommended
by the Mohave County Planning and Zoning Commission, subject to
the conditions outlined herein.
