HomeMy WebLinkAbout94-296 .'- ::.. . iiClllflOOD I b7 INnEXED RESOLUTION NO. 94-296 A RESOLUTION SETTING FORTH APPROVAL OF AN ~ENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF CHARISMA, TRACT 4109, BEING A PORTION OF T~E W\ OF THE SE\, SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 6, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Subdivision Plan of Charisma, Tract 4109, and WHEREAS, the owner/developer of this tract is LEFCO Diversified of Murrieta, California. The engineer responsible for the preparation of the drainage report and design of this subdivision is Holland West, Inc., Bullhead City, Arizona, and WHEREAS, the proposed subdivision is in the Fort Mohave area approximately two miles east of SR 95 on the north side of Joy Lane, and WHEREAS, according to the developer, water will be supplied by Bermuda Water Company, electric power by Mohave Electric Cooperative, and telephone service by Citizens Utilities Company. The developer has entered into a contract with the Fort Mojave Tribal Utility Authority for sewage disposal. Fort Mojave Mesa Fire Department will be providing fire protection for this project, and private carrier will be collecting and transporting solid waste to the Mohave valley Landfill, and WHEREAS, the preliminary plan proposes a single family residential development with a typical lot size of 7,200 square feet. The majority of the project will consist of site-built housing, with some multi-family development at 20 units per acre and a small neighborhood commercial parcel, and WHEREAS, Article 3.10-1 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken, then all proceedings relating to the plat shall be terminated", and RESOLUTION NO. 94-296 Page 2 .. . . PAGE 2 OF BK 2Hl PG 2 4 (FEE~94-~3~44) WHEREAS, in a letter dated June 28, 1994, Mr. Phillip See, owner/developer, advised that the severe economic conditions in the area are responsible for the postponement of the project, and WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of Supervisors on July 2, 1990, via BOS ReSOlution NO. 90-169. The first Extension of Time was granted on November 2, 1992, via BOS Resolution No. 92-385. BOS Resolution No. 94-95 granted the second Extension of Time. This will be the third Extension of Time, and WHEREAS, at a public hearing on August 10, 1994, the Mohave County Planning and Zoning Commission recommended APPROVAL of the requested Extension of Time subject to the following: 1. Compliance with BOS Resolution No. 90-169. 2. This Extension of Time will be in effect until July 2, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulat:i.on, in Kingman, Mohave County, Arizona on August 21, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday. September 6, 1994, APPROVED the Extension of Time for Charisma, Tract 4109, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
