PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 94-295 A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF MOON RIDGE, TRACT 4119, BEING A PORTION OF THE SE\, SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 6, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Subdivision Plan of Moon Ridge, Tract 4119, and WHEREAS, the owner/developer of this tract is Joe Van Mouwerik, Redlands, California. The engineer of record is Territorial Engineers, Inc., Bullhead City, Arizona, and WHEREAS, this subdivision is located next to subdivision, one and one-half miles east of subdivision straddles Hammer Lane, and Tierra Del Rio SR 95. The WHEREAS, the Preliminary Plan depicts 30 acres subdivided into 99 single family residential lots ranging in size from 8,800 square feet to 15,925 square feet, to yield a density of 3.3 dwellings per acre, and WHEREAS, the developer intends to provide water from Bermuda Water Company; electric power will be furnished by Mohave Electric Cooperative; on-site septic systems will accommodate sewage disposal; and Tri-State Refuse will remove and transport the solid waste to the Mohave County Landfill. This project is located within the Fort Mojave Mesa Fire District, and WHEREAS, Article 3.10-1 states, "upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one year may be granted by the Board if the subdivider-is actively processing the Final Plat. If such action is not taken, then all proceedings relating to the plat shall be terminated", and RESOLUTION NO. 94-295 Page 2 " . . PAGE 2 OF 2 BK 2,61 PG 2 (FEE:9,-53~43l WHEREAS, in a letter dated June 6, 1994, Charles K. Dewald, representative of the developer, advised that the first phase of the project has been recorded. The Final Plat for Phase II has been reviewed by staff and is ready for Board action. Economic conditions were cited as the factor responsible for inaction on the remainder of this tract, and WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of Supervisors on January 7, 1991, via BaS Resolution No. 91-4. BaS Resolution No. 92-384 granted the first Extension of Time for this project. That Extension of Time expired January 7, 1994. This will be the second Extension of Time, and WHEREAS, at a public hearing on August 10, 1994, the Mohave County Planning and Zoning Commission recommended APPROVAL of the requested Extension of Time subject to the following: 1. Compliance with all conditions as stated in BOS Resolution No. 91-4. 2. This Extension of Time will be in effect until January 7, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper' of general circulation, in Kingman, Mohave County, Arizona on August 21, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 6, 1994, APPROVED the Extension of Time for Moon Ridge, Tract 4119, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
