PAGE 1 OF 3 MOHAVE CDUHTY SOARD OF SUPERVISORS RECORDING fEE 0.00 He RESOLUTION NO. 94-279 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 27-13, MOUNTAIN VISTA RANCHES, SECTION 27, TOWNSHIP 24 NORTH, RANGE 15 WEST FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) TO A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA, WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 8, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owner J. J. DiConza Ent., Inc., M.P./P.S. Comingled Trust of Morgan Hill, California, and WHEREAS, the property is located north of Highway 66 and west of Antares Road. The property is accessed from Highway 66 via Concho Drive, then north to Painted Rock Drive, then east/northeast to an unnamed roadway easement, then west to the property, and WHEREAS, the surrounding land uses consist of vacant land and residential homes in the Valle Vista subdivision to the south. The site proposed for rezoning is vacant, and WHEREAS, Mountain Vista Ranches is a 40-acre subdivision divided by Record of Survey recorded December 15, 1993, in Book 11 of Records of Survey, Pages 34-34G, Mohave County. The roads in the development have been bladed and there is electric power along the southern boundary of the development. There are no public utilities servicing the site, and WHEREAS, the owner intends to divide the parcel into two 10- acre parcels and one 20-acre parcel, and WHEREAS, review 2005B indicates this minimal flooding, and of Floodplain Map parcel is located Nos. 040058-2000B and in Zone C, an area of WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 13, 1994, the Commission recommended APPROVAL for a rezone subject to the following: ~ . . RESOLUTION NO. 94-279 Page 2 PAGE 2 OF OK 244& PG 3 46 (r[E;94-47002l 1. The parcels be zoned A-R/10A (Agricultural-Residential/ Ten Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.l6 of the Mohave County Subdivision Regulations and l02. 04-B of the Standard Specifications. 3. That the Board of Supervisors accept the dedication of a 30-foot road right-of-way along the southern boundary and on the eastern boundary along the southeast parcel, and the dedication of an appropriately sized radius curve at the intersection of the two roadways, In addition, the granting of an eight-foot PUE along the side of the proposed dedications. The dedication and granting required by the rezoning resolution shall be shown on the parcel plat and accepted by the Board of Supervisors upon parcel plat recordation. 4. The parcels will meet or exceed their respective acreage exclusive of road easements, 5, Each parcel shall have legal access, 6. The Parcel Plat shall show any surface drainage and FEMA flood zones. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E, 9, If these conditions are not met wi thin one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoni_ng classification, This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. . . . . RESOLUTION NO, 94-279 Page 3 PAG:;: 3 OF 3 BK 2446 PG 47 (FEE~94-47002) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 24, 1994, and posted July 22, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 8. 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
