PAGE 1 OF 2 MOHAVE COUHTY BOARD Of SUPERVISORS REcnRDIMG rEE 0.00 N" RESOLUTION NO. 94-270 A RESOLUTION SETTING FORTH A REZONE OF THE W\ OF THE N\ OF LOT 5, AND THE w\ OF THE E\ OF THE N\ OF LOT 5, PARADISE ACRES, UNIT 1, SECTION 14, TOWNSHIP 21 NORTH, RANGE 18 WEST FROM A-R/2A (AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) TO A-R/IA (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 8, 1994, a publiC hearing was conducted to determine whether approval should be granted for a rezone for the above described property to Ted Agee of Bullhead City, Arizona, and WHEREAS, the property is located on Shipp Drive, north of Tangerine Drive and west of Hope Road. This land is accessed via Hwy. 68, then south on Hope Road, then east on Shipp Drive to the site, and WHEREAS, the site is flat with nO washes crossing the property, and WHEREAS, the owner proposes to split the 3.19-acre parcel into three separate one-acre parcels, and WHEREAS, review of Floodplain Map #040058-2325B indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July l3, 1994, the Commission recommended APPROVAL for a rezone subject to the following: 1, The parcels be zoned A-R/IA (Agricultural-Residential/ One Acre Minimum Lot Size). 2. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and l02.04-B of the Standard Specifications. 3, A 20- foot radius curve at the intersection of Shipp Drive and Higly Road shall be dedicated. - 4 <. t . RESOLUTION NO, 94-270 Page 2 PAGE :1 or 2 BK ~4~~ PG 19 (rEEt94-4~994) 4. An 8~foot PUE shall be granted along the north and west boundaries of this parcel. ' 5, Each parcel shall meet or exceed their respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The parcel plat shall show any surface drainage and FEMA flood zones. 8. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E, 10. I f these conditions are not met wi thin one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the SChedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 24, 1994, and posted July 22, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board Of Supervisors, at their regular meeting on Monday, August 8, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission d outlined herein.
