OF nQHAVE COUNTY 80ARD OF SUPERvISORS RECORDIHG FEE 0.00 NC RESOLUTION NO. 94-231 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF SECTION 13 LYING WEST OF 1-40, SECTION 13, TOWNSHIP 17 NORTH, RANGE 18 WEST, FROM A-R/IA, A-R/5A AND A-R/I0A (AGRICULTURAL-RESIDENTIAL/ONE ACRE, FIVE ACRE AND TEN ACRE MINIMUM LOT SIZES), C-2 (GENERAL- COMMERCIAL), C-M (COMMERCIAL-MANUFACTURING) AND M (GENERAL- MANUFACTURING) TO M-X (HEAVY MANUFACTURING) IN THE YUCCA PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above property to representative Don Van Brunt of the Mohave County Economic Development Authority, Kingman, Arizona, and WHEREAS, the site is located south of the Yucca Townsite between Interstate 40 and the Atchison, Topeka and Santa Fe Railroad right-of-way. The site is accessed from Interstate 40 via the Alamo Road exit, then west to the property, and WHEREAS, the surrounding land uses consist primarily of vacant land. Residential homes and a few commercial businesses are located to the north of the Yucca Townsite. The property proposed for rezoning is vacant, and WHEREAS, the site meets muCh of the criteria set forth in) the Mohave County Zoning Ordinance for possible M-X zon<r locations. The site has access to adequate transportation including'~an interstate highway and a rail line. The surrounding land uses are favorable with the rail line bordering the property on the west, Interstate 40 on the east, and BLM land on the south. The land to the north is vacant which provides a potential for creating a land use buffer zOne between the industrial and residential uses. Public utilities are available to the site. Electric power for the site is still being negotiated; however, there are alternatives available to address the electric power issue, and WHEREAS, the site for the proposed rezone inCludes an existing industrial park Subdivision (Cal-Ari Industrial Park, Tract 1094) and an SO-acre parcel. An abandonment is proposed for Cal-Ari Industrial Park, Tract 1094. The resulting acreage will be combined with the adjacent SO acres to create one large parcel, and .. -; . . The proposed rezoning will create one specific zoning for the entire site. The proposed M-X zoning will permit other industrial uses, each requiring a Specific Use Permit, and WHEREAS, the developer proposes a finished paper plant on the site which will include a number of manufacturing buildings, a shipping building, a possible office and outdoor water evaporation ponds. The facility will be constructed in three phases, and WHEREAS, the proposed paper plant will cover most of the site. Any portion of the site not being used will be available for future utility facilities and other private enterprises, and WHEREAS, review of Floodplain Map #040058-2675B indicates this parcel to be in Zones A and C. The portion in zone A is an area of 100-year flood, base flood elevations and flood hazard factors not determined. The remainder of the parcel is in Zone C, an area of minimal flooding. This parcel requires a Floodplain Use Permit for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 8, 1994, the Commission recommended APPROVAL for a rezone subject to the following: 1. The parcel be zoned M-X/36A (Heavy Manufacturing/ Thirty-six Acre Minimum Lot Size). 2. That appropriate zoning, building, environmental and floodplain permits be obtained. 3. The portion Of the property to be zoned M-x/36A is designated in "Exhibit A". 4. '~hat each use on the site shall require a Specific Use permit. 5. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations and compliance with Section 27.P (Site Plan Requirements). 6. The rezone shall not become effective until 30 days after final approval of ,the change in classification by the Board of Supervisors, as per ARS 11-829E. " , n-i . . RESOLUTION NO. 94-231 Page 3 PAGE 3 OF ~ BK 1~30 PG +12 (FEEt9+-fQ39~) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 19, 1994, and posted June 20, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, July 5, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
