RESOLUTION NO. 94-229
A RESOLUTION SETTING FORTH A REZONE OF LOT 17, TORO ACRES,
SUNWARD HO! RANCHES NO.2, SECTION 19, TOWNSHIP 23 NORTH, RANGE
16 WEST, FROM A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM
LOT SIZE) TO A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM
LOT SIZE) IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on July 5, 1994, ~ public hearing was
oonduoted to determine whether ~pproval should be granted for a
rezone for the above described property to owner James Helwig of
Golden Valley, Arizona, and
WHEREAS, the property is located east of Stockton Hill Road
and north of Calle Charcas. This land is accessed via Stockton
Hill Road, then east on Wilks Ranch Road, then north on Cherum
Road to Cal1e Charcas, then east to Avenida Mendez, then north to
Calle Caliente. The site is located on the south side of Calle
Caliente, and
WHEREAS, the property is vacant with a few residential
buildings in the vicinity. The rolling terrain rises to a small
knoll in the southern one-third of the property; a minor wash is
located in the northern part of the property, and
WHEREAS, the owner intends to divide the property into three
separate parcels for single-family residences, and
WHFR.:;AS, legal access for parcel 17A will be from Calle
Caliente. Parcels 17B and 17C will be accessed from a proposed
40-foot roadway on the east side of the parcel, and

WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on June 8, 1994, the Commission
recommended APPROVAL for a rezone subject to the following:
1. The parcels be zoned A-R/5A (Agricultural-Residential/
Five Acre Minimum Lot Size).

2. Submittal and recordation of a parcel plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations, 102.04-B of the Standard
Specifications and 32.B2 of the Zoning Regulations.
3. That the Board of Supervisors accept the dedication of
a 40-foot road right-of-way on the eastern portion of
the property to terminate on the northern boundary of
the southern parcel, and a 20-foot radius curve at the
intersection of the proposed right-of-way and Calle
Caliente. The dedication required by the rezoning
resolution shall be shown on the Parcel Plat and
accepted by the Board of Supervisors upon Parcel Plat
recordation.
4. That the Board of Supervisors approve the name Calle
patilla for a 40-foot road right-of-way along the
eastern boundary of the proposed parcels, and that the
road name be shown on the Paroel Plat.
5. The parcels shall meet or exceed their respective
acreages exclusive of roadways.
6. Each parcel shall have legal access.
7. The Parcel Plat shall show any surfaoe drainage and
FEMA flood zones.
8. That appropriate zoning, building, environmental and
floodplain permits be Obtained prior to any
development. These permits will not be issued until
Parcel Plat recordation.
9. The rezone shall not become effective for 30 days after
final Board of supervisors approval for the change in
_""classification, as per ARS 11-829E.
10. If these conditions are not met within one year this
approval will be void. If at the expiration of this
period the property has not been improved to meet the
use for which it was conditionally approved, the Board
(after notifioation by registered mail to the owner and
applicant who requested the rezoning) shall schedule a
public hearing to grant an extension, determine
complianoe with the sohedule for development, or cause
the property to revert to its former zoning
classifioation. This aotion is in acoordance with
Arizona Revised Statutes Annotated, Title 11, Chapter
6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, June 19, 1994, and posted June 20, 1994,
as required by Arizona Revised Statutes and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, July 5, 1994, APPROVED this
rezone as recommended by the Mohave County Planning and zoning
Commission and outlined herein.
