" '" nOHAVE COUNTY eO/lRD OF SUPERVISORS '~"-<'" ."~..'i RECOROItKi FEE 0.00 Me RESOLUTION NO. 94-228 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 38, EXCEPT THE SE 723 FEET OF THE NE 724 FEET, AND ALSO EXCEPTING THERE FROM THE SE 1124 FEET THEREOF, EXCEPT THE NE 724 FEET THEREOF, PEACOCK MOUNTAIN RANCHES, SECTION 7, TOWNSHIP 21 NORTH, RANGE 15 WEST, FROM A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) TO A-R/5A AND A-R/4A (AGRICULTURAL-RESIDENTIAL/FIVE AND FOUR ACRE MINIMUM LOT SIZES) IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above property to Edward and Karen Early of Rockville, Maryland, and WHEREAS, the property is located east of Roundup Avenue and north of Taos Drive. The land is accessed via D.W. Ranch Road on 1-40, then east on the 1-40 frontage road to Roundup Avenue, then northwest to the site, and WHEREAS, the property is primarily vacant with a few scattered residences and small out-buildings in the area. The terrain is gently rolling hills, and WHEREAS, the owner intends to divide the property into three parcels for single-family residences, and WHEREAS, legal access to the parcels will be from a proposed 50- foot _aedicated roadway. This roadway will terminate with a 50-foot radius cul-de-sac, and WHEREAS, there are no major washes or drainage that cross the property, and WHEREAS, indicates that flooding, and review of FEMA Floodplain Map #040058-2350B the property is within Zone C, an area of minimal WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 8, 1994, the Commission recommended APPROVAL for a rezone subject to the following: . . . RESOLUTION NO. 94-228 Page 2 PAGE 1 OF 3 BK 2430 PG ~02 (FEE.9~-40392) 1. The parcels be zoned A-R/5A and A~R/4A (Agricultural- Residential/Five Acre and Four Acre Minimum Lot Size). 2. Submittal and recordation accordance with Article Subdivision Regulations, Specifications. of a parcel plat prepared in 3.16 of the Mohave County and 102. 04~B of the Standard 3. That the Board of Supervisors accept the dedication of a 50-foot road right-of-way and cul-de-sac bulb on the southwestern portion of the property and a 20~foot radius curve at the intersection of the proposed right- of-way and Roundup Avenue. In addition, the granting of an 8-foot PUE along the side of the proposed right- of-way. The dedications and granting required by the rezoning resolution shall be shown on the parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 4. That the Board of Supervisors accept the name Early Circle for a 50~foot road right-of~way, and that the name be shown on the Parcel Plat. 5. The parcels shall meet or exceed their respective acreages exclusive of roadways. 6. Each parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. ..~ ~' 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. . . . . RESOLUTION NO. 94-228 Page 3 PAG~ 3 OF J BK 2430 PG 403 (F~E.94~40392) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 19, 1994, and posted June 20, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, July 5, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
