PAGE 1 OF ~ MOHAVE COUNTY 1l0ARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 94-227 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 27-6, MOUNTAIN VISTA RANCHES, SECTION 27, TOWNSHIP 24 NORTH, RANGE 15 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) TO A-R/lOA (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above property to Steve and Claudette Santos of Victorville, California, and WHEREAS, the property is located north of Highway 66 and west of Antares Road. The property is accessed from Highway 66 via Concho Drive, then north to Painted Rock Drive, then east/northeast to an unnamed roadway easement, then west to the property, and WHEREAS, the surrounding land uses consist of vacant land and residential homes in the Valle Vista subdi vision to the south. The site is vacant, and WHEREAS, Mountain Vista Ranches is a 40-acre subdivision divided by Record of Survey recorded December 15, 1993. The roads in the development have been bladed, and there is electric power along the southern boundary of the development. There are no public utility facilities servicing the site, and WHER2AS, the owner intends to divide the parcel into two 10- acre parcels and one 20-acre parcel, and WHEREAS, review of Floodplain Map #040058-2000B indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 8, 1994, the Commission recommended APPROVAL for a rezone subject to the following: 1. The parcels be zoned A-R/I0A (Agricultural-Residential/ Ten Acre Minimum Lot Size). . . RESOLUTION NO. 94-227 Page 2 PAGE 2 Of 3 eK 2430 FG 399 (FEE~9+-4Q391) 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications. 3. The parcels shall meet or exceed their respective acreages exclusive of road easements. 4. Each parcel shall have legal access. 5. The parcel Plat shall show any surface drainage and FEMA flood zones. 6. Tha t appropria te zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until parcel Plat recordation. 7. That the Board of Supervisors accept the dedication of a 30-foot road right-of-way along the southern and western boundaries of the property. In addition, the granting of an eight-foot PUE along the side of the proposed right-of-way. The dedication and granting required by the rezoning resolution shall be shown on the parcel plat and aocepted by the Board of Supervisors upon parcel plat recordation. 8. The rezone shall not become effective until after final Board of Supervisors approval change in olassification, as per ARS ll-829E. 30 for days the 9. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board -.~(after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 19, 1994, and posted June 20, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~ . . RESOLUTION NO. 94-227 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting On Tuesday, July 5, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
