PAGE 1 Of 1 MOHAVE COUNTY eOARO OF SUPERvISORS RECOROIH5 FEE J Q.Qq,~f ( di' J' I ~!\b )~'~', tl" ~i)'\f '\ ql' J~I3' I l RESOLUTION NO. 94-221 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF LOT 262, PARADISE ACRES UNIT #2, SECTION 27, TOWNSHIP 20 NORTH, RANGE 18 WEST, FROM A-Rj2A (AGRICULTURAL-RESIDENTIALjTWO ACRE MINIMUM LOT SIZE) TO A-RjlA (AGRICULTURAL-RESIDENTIALj ONE ACRE MINIMUM LOT SIZE) IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners Lloyd and Mary Montgomery of Kingman, Arizona, and WHEREAS, the property is located on Morocco Drive south of Oatman Road and west of Centennial Road. This land is accessed via Oatman Road, then south on Centennial Road to Morocco Drive, then west to the site, and WHEREAS, there are two residences located on the property which are not in conformance with current zoning. It appears that the residence on the west side of the property is inhabited; the property on the east side is not. There are several power lines which border the property and one which crosses directly over the residence on the east side of the property, and WHEREAS, the property is primarily flat with no significant washes crossing the property, and WHEREAS, indicates"'that flooding, and review of FEMA Floodplain the property is within Zone C, Map #040058-2500B an area of minimal WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 8, 1994, the Commission recommended APPROVAL for a rezone subject to the following: 1. The parcels be zoned A-RjlA (Agricultural-Residentialj One Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdiv:is:ion Regulations, and 102.04-B of the Standard Specifications. ~ ~ . . RESOLUTION NO. 94-221 Page 2 PAGE 2 OF 2 BK 2~30 PG 385 (FEE~9~-40385) 3. The parcels shall meet or exceed their respective acreage exclusive of road easements. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 19, 1994, and posted June 20, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ..\,),1' NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, July 5, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
