RESOLUTION NO. 94-202
A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR
THE APPROVED PRELIMINARY PLAN OF MOUNTAINSIDE RANCH, TRACT 4106,
BEING A PORTION OF SECTION 6, TOWNSHIP 18 NORTH, RANGE 21 WEST,
LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held July 5, 1994, a public hearing was conducted
to determine whether approval should be granted for an Extension
of Time for the approved preliminary Subdivision Plan of
Mountainside Ranch, Tract 4106, and
WHEREAS, the owner/developer of this tract is Homes by Dave
Brown of Tempe, Arizona. The engineer responsible for the
preparation of the drainage report and design of this subdivision
is Holland West, Inc., Bullhead City, Arizona, and
WHEREAS, this project is located on the northeast corner of
Boundary Cone Road and Bison Road. Parcel "C" is located on the
south side of Boundary Cone Road and is proposed for multi-family
and cOlPmercial use, and
WHEREAS, this subdivision consists of 206 acres with 1004
single family units and three parcels reserved for multi-
family/commercial development, and
WHEREAS, Article III, Section 3.10, states, "Upon
application to the Commission and prior to the expiration of the
time limit, extensions in increments of one year may be granted
by the Board if the subdivider is actively processing the Final
Plat. If such action is not taken then all proceedings relating
to the plat shall be terminated."

WHEREAS, the preliminary plan for this tract was approved by
the Mohave County Board of Supervisors on May 5, 1990, via BOS
Resolution No. 90-113. A final plat of Mountainside Ranch, Tract
No. 4106-A, was conditionally approved by the Board of
Supervisors on September 17, 1990, and recorded December 18,
1990. A final plat of Tract No. 4106-B was conditionally
approved by the Board of Supervisors December 17, 1990, but has
not been recorded. A final plat of Tract No. 4106-C also was
condi tionally approved by the Board of Supervisors on December
17, 1990, but has not been recorded. A final plat of Tract No.
4106-D has not received approval, and
WHEREAS, an updated preliminary sUbdivision phasing plan was
received on February 6, 1992. This plan has seven phases, and
WHEREAS, Board of Supervisors Resolution NO. 92-140 approved
a mobile home as a sales office in an A-R (Agricultural-
Residential) zone on May 4, 1992. The Zoning Use Permit allowing
the use of a mobile home as a sales office in an A-R
(Agricultural-Residential) zone was rescinded via BOS Resolution
No. 93-154 on June 7, 1993. The portion of the subdivision in
";lhich sales would have taken place has now been abandoned and
reverted to acreage, and
WHEREAS, on August 21, 1992, the Board of Supervisors
approved an abandonment and reversion to acreage via BOS
Resolution Nos. 92-252 and 253. The actions removed all recorded
information concerning Tract 4106-A from the Mohave County
Recorder's and Assessor's files and returned this tract to an
approved final stage. Condition number 1 in Resolution No. 92-
252 states, "That the tract remain an approved final as set forth
in the Board of Supervisors Resolution No. 90-254". Condi tion
number 8 of the same resolution states, "It is further understood
that the continued perpetuation of the final maps based on
approved Preliminary Plat 4106, Board of Supervisors Resolution
No. 90-:!.,:Ci, depends on requesting and receiving Extensions of
Time for that approved preliminary, as required by the Mohave
County Subdivision Regulations," and
WHEREAS, before the final plat for Tract 4106-A is recorded,
all of the conditions contained in BOS Resolution No. 90-254
would have to be complied with. The water allocation has been
returned to MVIDD by the Arizona Department of Water Resources.
Required information which has lapsed must be updated, and the
water allocation must be reinstated, and

WHEREAS, Board of Supervisors Resolution No. 92-143 extended
the approved Preliminary plan to May 7, 1993. Board of
Supervisors Resolution No. 93-154 extended the approved
preliminary Plan to June 7, 1994. This will be the third
Extension of Time, and
WHEREAS, at a public hearing on June 8, 1994, the Mohave
County Planning and Zoning Commission recommended APPROVAL of the
requested Extension of Time subject to the following:
1. Compliance with all conditions of Resolution No. P&ZC
90-113 and BOS Resolution Nos. 90-254, 92-252 and 92-
253.
2. All concerns delineated in a letter from Harold Ganyo,
Mohave County Engineer, dated March 6, 1992, shall be
addressed prior to the recordation or re-recordation of
Phases A, Band C (see Exhibit "A").
3. prior to the recordation or re-recordation of approved
Phases A, Band C, a complete review of the final maps
and resubmi ttal of required documentation to verify
compliance with all provisions of Article III, Sections
3.10-3.15 (Final Plat Requirements) and Article V
(Assurance for Completion of Improvements), Mohave
County Subdivision Regulations.
4. This Extension of Time will be in effect until May 5,
1995.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation, in Kingman,
Mohave County, Arizona on June 19, 1994, as required by the
Arizona Revised Statutes and the Mohave County Zoning
Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, July 5, 1994, APPROVED the
Extension of Time for Mountainside Ranch, Tract 4106, as
recommended by the Mohave County Planning and Zoning Commission,
subject to the conditions outlined herein.

. The response letter from Holland West, Inc dated December 7, 1990
was addressed by a memorandum from Richard Skalicky, P. E., Director
of Public Works. This Memorandum was sent to Jim Neblett, Planning
and Zoning Director. As stated in our January 27, 1992 letter
responding to P&Z'S request for outstanding concerns in regard to
this development, we noted items 2-5 of this letter had not been
adequately addressed. These outstanding items are listed below.
2. The engineer states he feels this development will be protected
even if adjacent parcels are not developed prior to this
subdivision. It is proposed to construct temporary cutoff ditches
to protect this subdivision. However, the temporary cutoff ditches
are not within the boundaries of this subdivision, therefore
easements should be provided for these temporary ditches to allow
any necessary maintenance activities and to insure their integrity
until future drainage improvements negate their necessity. The
engineer ,should provide documentation that these proposed temporary
cutoff -d{tches will provide adequate protection to all lots
impacted by any flows entering this phase of development.
3. We d~ not expect a design for parcel C at this stage.' however,
the eng~neer should provide a statement that the proposed
subdivision design will not have a negative impact on Parcel C or
areas adjacent to it.
4. When can we expect a submittal of this revised drainage report,?
5. Again we do not expect a design for this area, just a statement
by the engineer as discussed in item 3 above.

_ The first part of comment 112 has been addressed by the provision
of offsite drainage easements. however documentation of the
proposed cutoff ditches design, capacities, etc... has not been
provided for review as of this date.
