PAGE 1 OF 2 nOHAVE COUNTY BOARD OF SUPERVISORS RtCOROIH~ F~E 0.00 He RESOLUTION NO. 94-201 A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR EMERALD RIVER ESTATES, TRACT 4093, BEING A PORTION OF THE Nlo;; OF THE NW\, SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regu~ar meeting of the Mohave County Board of Supervisors held September 6, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Subdivision Plan of Emerald River Estates, Tract 4093, and WHEREAS, the owner/developer of this tract is Randy Hanshaw, President, Emerald River Development, InC., Bullhead City, Arizona. The engineer responsible for the preparation of the drainage report and design of this subdivision is Raymond W. Stadler, P.E., Stadler Consulting Engineers, Inc., Phoenix, Arizona, and WHEREAS, the preliminary subdivision plan depicts this 32.3- acre parcel divided into 107 lots. Lot sizes range from 9,585 square feet to 16,700 square feet which provides a density of 3.3 lots per acre, and WHEREAS, Article 3 .10~1 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and WHEREAS, in a letter dated March 11, 1994, Mr. Randy Hanshaw, representing Emerald River Estates, states: "In talking with Ray Stadler of Stadler Consulting Engineers, he informed me that ADEQ has had the plans in their possession since March of 1993, and have gone through a number of different employees. Therefore most of the documents have been misplaced. Ray stated he replaced all documents necessary. ADEQ is now working on my project. We expect to be out of ADEQ very shortly. "I apologize for this delay and I am working to obtain all approvals as soon as possible to get this completed." . ,'" . tt RESOLUTION NO. 94-201 Page 2 PAGE 2 0, 2 BK 2~60 PG 991 (FEE~94-S3537) The preliminary plan for this tract was approved by the Mohave County Board of Supervisors on March 5, 1990, via BOS Resolution No. 90-58. The first Extension of Time, which expired March 5, 1993, was granted via BOS Resolution No. 93-4 on January 4, 1993. This will be the second and third Extensions of Time for this project, and WHEREAS, at a public hearing on June 8, 1994, the Mohave County Planning and Zoning Commission recommended APPROVAL of the requested Extension of Time subject to the following: 1. Compliance with all conditions of BOS Resolution No. 90-58. 2. This Extension of Time will be in effect until March 5, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona on August 21, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 6, 1994, APPROVED the Extension of Time for Emerald River Estates, Tract 4093, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
