PAGE 1 Of 2 HO~AV( COUNTY BOARO Of SUPERVISORS RECORDI~G fEE 0.00 HC RESOLUTION NO. 94-450 A RESOLUTION SETTING FORTS A REZONE OF LOT 1, BLOCK 2, OF BERRY ACRES UNIT NO.1, LOCATED IN A PORTION OF THE NW\ OF SECTION 4, TOWNSHIP 21 NORTH, RANGE 16 WEST, FROM c-2 (GENERAL COMMERCIAL) ZONE TO C-MO (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA. WlIEREA8, at the :regular meeting of the Mohave county Board of supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Thomas R. and Linda B. Orr of Kingman, Arizona, and WlIEREAS, the property is located south of Gordon Drive and east of North Castle Rock Road. The property is accessed from Andy Devine Avenue, west on Gordon Drive, then south to the site. The Kingman City Limits is on the west side of the property, and WlIEREAS, the property is vacant and flat. surrounding land uses include several commercial businesses to the southeast along Andy Devine Avenue, to the north are several residences and a truck storage yard. On the west side of the site are two residences, a mini-storage facility and a commercial refueling station. The Kingman City water works is located to the northwest of this site, and WHEREAS, the developer proposes to construct a truck terminal, and WHEREAS, the public works Department is concerned about the structural section of Gordon Avenue with the anticipated increase of truck traffic. They are requesting additional right-of-way to properly construct the roadway section to accommodate this truck traffic and to provide possible future acceleration or deceleration lanes if needed, and WHEREAS, review of Floodplain Map #040058-2l65C indicates this parcel to be in Zone C, not in FEMA special flood hazard area. A Floodplain Use Permit is not required, and ~ '. I ., RESOLUTION NO. 94-450 Page 2 PAG[ :1 Of 2 BY. 2499 PG 9&3 (fEE~94~71304) WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the commission recommended APPROVAL for a Rezone subject to the following: 1. The property be zoned C-MO/3A (Commercial-Manufacturing/Open Lot Storage/Three Acre Minimum Lot site). 2. That the Board of supervisors accepts the dedication of a 45-foot radius curve at the intersection of Gordon Avenue and Castle Rock Road to accommodate truck traffic turning movements. 3. That the Board of Supervisors accepts the dedication of 20 feet of road right-of-way on Gordon Avenue adjacent to this site, increasing the e~isting 40-foot road right-of-way to 60 feet. 4. That the structural cross section of Gordon Avenue be improved to be able to accept the stress of the additional truck traffic from Castle Rock Road to Andy Devine Avenue (Highway 66). 5. That the appropriate zoning, building, environmental and floodplain permits be obtained. 6. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations and Section 27.P (Site Plan Requirements). 7. The Rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARB 11-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave COunty, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the BOard of Supervisors, at their regular meeting on Monday, December 5, 1994, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning commission and outlined herein.
