PAGE 1 OF 2 ~OHAVE COUNTY BOARD OF SUPERVISORS RECORDI~ FEE 0.00 He RESOLUTION NO. 94-447 A RESOLUTION SETTING FORTH AN ABANDONMENT OF ROADWAYS AND EASEMENTS IN LAKE RAVASU ESTATES, MORAVE CENTER, UNIT 1, TRACT 1168, EXCEPT MORAVE CENTER BOULEVARD, STEVENS DRIVE, CASE ROAD SOUTH OF STEVENS DRIVE, PARCELS A, B, C, D, AND E, THE 16-FOOT PUBLIC UTILITY AND DRAINAGE BASEMENTS ALONG THE NORTH AND EAST BOUNDARIES AND ALL HIGHWAY DRAINAGE EASEMENTS LOCATED ALONG THE WEST BOUNDARY ADJACENT TO I-40, ALL LOCATE)) ON A PORTION OF SECTION 13 LYING EAST OF 1-40, SECTION 13, TOWNSHIP 17 NORTH, RANGE 18 WEST IN THE YUCCA PORTION OF THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County BOard of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for an abandonment for the above described property to Triple G Partnership of Kingman, Arizona, and WHEREAS, the area proposed for abandonment is located south of the Yucca Townsite and east of Interstate 40. The property is accessed from Interstate 40 via Alamo Road, then east to the site, and WHEREAS, the existing subdivision is proposed for abandonment and reversion to acreage to create larger parcels that will be more sui table for commercial and industrial development. Some of the roadways will not be abandoned to maintain the vehicular circulation on the site. There is a drainage area on the west side of the site adjacent to 1-40 that will also remain. As the parcels are developed new roadways and easements will be created, and WHEREAS, Citizens Utilities Company has power lines on the site that are not located within easements. New easements will have to be created for these power lines, and WHEREAS, the owner of the property is proposing to rezone the property to permit commercial activities. The abandonment will permit more flexibility in how the property is developed, and WHEREAS, the Mohave County Subdivision Regulations indicate in Section 1.12-7 that the application to abandon streets or easements shall be made pursuant to the Arizona Revised Statutes and shall be carried on separately and simultaneously with any procedure to abandon a subdivision or revert it to acreage. The abandonment and reversion to acreage is being processed separately, and '- . . . RESOLUTION NO. 94-447 Page 2 PAGE 2 OF 2 SK 2499 PG 9~6 (rEE~94~71301) WHEREAS, review of Floodplain Map #040058-2675B indicates this parcel is located in zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on November 9, 1994, the Commission recommended APPROVAL for an abandonment subject to the following: 1. That the roadways and easements in LAKE HAVASU ESTATES, MORAVE CENTER, Unit 1, Tract 1168, except Mohave Center Boulevard, stevens Drive, Case Road south of Stevens Drive, Parcels A, B, C, D, E, the 16-foot PUE and DE along the north and east boundaries and all Highway Drainage Easements located along the west boundary adjacent to 1-40, all located on a portion of section 13 lying east of 1-40, Section 13, Township 17 North, Range 18 be abandoned. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave COunty, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, their regular meeting on MOnday, Abandonment as recommended by the commission and outlined herein. that the Board of Supervisors, at December 5, 1994, APPROVED this Mohave COunty Planning and Zoning MORAVE COUNTY BOARD OF SUPERVISORS AT'l'EST: ~M. ~.
