A RESOLUTION SETTING FORTH A REZONE OF PARCEL 2, AS SHOWN IN BOOK 4,
PAGE 22 OF PARCEL PLATS, SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST,
FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2H (GENERAL-
COMMERCIAL/HIGHWAY FRONTAGE) ZONE IN THE MORAVE COUNTY GENERAL AREA,
MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board of
Supervisors held on December 5, 1994, a public hearing was conducted
to determine whether approval should be granted for a Rezone for the
above described property to Dunton, Dunton & Sim of Kingman, Arizona,
and .
WHEREAS, the property is located approximately four miles
southwest of the Kingman city limits. This land is accessed from
Interstate Highway 40 via the Oatman Road off-ramp to Oatman Road,
then northeast to the site, and
WHEREAS, the property is flat with a gently rising slope from the
southwest to the northwest. There are residences to the west and
south of the property. Roadway, a commercial truck terminal, is
adjacent to this parcel on the east and has a 6-foot view obscuring
fence dividing the properties, and
WHEREAS, this site is wi thin the limits of the McConnico Area
Plan; the designation given this specific area is Urban (commercial/
industrial), and
WHEREAS, review of FEMA Floodplain Map #040058-2325B indicates
this parcel is within zone C, an area of minimal flooding, and
WHEREAS, at the public hearing before the Mohave County Planning
and Zoning Commission on November 9, 1994, the commission recommended
APPROVAL for a Rezone subject to the following:
1. The eastern parcel be zoned C-2H/2A (General-commercial
Highway Frontage/TwO Acre Minimum Lot Size) and the western
parcel be zoned C-2H/7A (General-Commercial Highway
Frontage/Seven Acre Minimum Lot Size).
2. Submi ttal and recordation of a Parcel Plat prepared in
accordance wi th Article 3.16 of the Mohave County
Subdivision Regulations, and 102.04-9 of the Standard
Specifications.

3. The applicant comply with all applicable provisions of the
Mohave County Zoning Regulations, compliance with Section
27.P (Site Plan Requirements), and a drainage report.
4. A Right-of-Way Encroachment Permit will need to be obtained
from Mohave County for the method of connecting the plant
access road to Oatman Road.
5. A six-foot high block wall shall be erected along the west
and north boundaries of the parcel to buffer the site from
residential areas.
6. A PUE and DE shall be granted in the northwest corner of the
parcel. It will be a continuation of the alignment of
Parcel "3" of Walnut Creek Estates, Unit 2, Block 1.
Furthermore, the Board Shall accept a 40-foot PUE and DE
along the north and east boundaries of the property.
7. The granting required by the Rezone resolution shall be
shown on the parcel Plat and accepted by the Board of
Supervisors upon Parcel Plat recordation.
8. Each parcel shall have legal access.
9. The Parcel Plat shall show any surface drainage and FEMA
flood zones.

12. If these conditions are not met within one year, this
approval will be void. .If at the expiration of this period
the property has not been improved to meet the use for which
it was conditionally approved, the Board (after notification
by registered mail to the owner and applicant who requested
the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for
development, or cause the property to revert to its former
zoning classification. This action is in accordance with
Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-
832.

WHEREAS, the notice of hearing was published in the Kingman Oaily
Miner, a newspaper of general circulation in Kingman, Mohave County,
Arizona, November 20, 1994, and posted November 18, 1994, as required
by Arizona Revised Statutes and the Mohave County zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Monday, December 5, 1994, APPROVED this
Rezone as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
