A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THAT PORTION OF GOVERNMENT LOTS 3, 4 AND 12 OF SECTION 4, TOWNSHIP 20 NORTH, RANGE 17 WEST, LYING NORTH AND WEST OF THE NORTHWESTERLY RIGHT-OF-WAY LINE OF INTERSTATE HIGHWAY 40 FOR THE ESTABLISHMENT OF A WRECKING YARD FACILITY IN AN A (GENERAL) ZONE IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the MOhave County Board of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Zoning Use permi t for the above described property to Alan pompa of Mohave Valley, Arizona, and WHEREAS, the land McConnico Interchange. McConnico Interchange, Road, then north on northeast of the Oatman is located west of I-40 and north of the I-40/ The property is accessed from I-40 via the then west to the Oatman Road/I-40 Frontage the Frontage Road approximately 1.3 miles Road exit and Frontage Road intersection, and WHEREAS, the site has a small building, a gravel pit and some miscellaneous mining equipment. The surrounding land uses consist of a concrete block plant and a proposed decorative rock sales yard to the northeast. The land to the west and southwest is vacant, and WHEREAS, General or "AU il'oning permits wrecking yards if approved by a Zoning Use Permit, and WHEREAS, review of Floodplain Map #040058-2325B indicates that Lot 3 is located in Zone A, FEMA special flood hazard area. A Floodplain Use Permit is required for any development. Lots 4 and 12 are located in Zone C, not in a FEMA special flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the publiC hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the commission recommended APPROVAL for a zoning Use permit subject to the following: "- . . . The wrecking yard be enclosed by a view obscuring fence. 3. The wrecking yard shall that pertain to junk Interstate highways. That appropriate zoning, build:l.ng, floodplain permits be obtained. adhere to the Federal guidelines yards within sight distance of 4. environmental and 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for s:l.x months, then approval shall terminate at that date. 6. This Zoning use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion Of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREaS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave COunty Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 5, 1994, APPROVED this Zoning use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
