PAGE 1 OF ~ HOHAVE COUWTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 94-436 A RESOLUT~ON SETTING FORTH A ZONING USE PERMIT ON LOT 21, BLOCK B OF ARIZONA WEST, TRACT 1112, SECTION 11, TOWNSHIP 23 NORTH, RANGE 15 WEST, FOR THE ESTABLISHMENT OF A TEMPORARY REAL ESTATE SALES OFFICE IN AN SD/C (SPEC:lAL DEVELOPMENT/COMMl!:RCIAL) ZONE IN THE NORTH KINGMAN PORTION OF THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 5, 1994, a publ~c hearing was conducted to determine whether approval should be granted for a Zoning Use permit for the above described property to Earl Hamlyn of Kingman, Arizona, and WHEREAS, the land is located within the Arizona West subdivision located approximately 15 miles northeast of Kingman and west of Highway 66. The property fronts Highway 66 with access from Buckboard Drive, and WHEREAS, the surrounding land uses cons~st of residential homes within Arizona West subdivision and a few commercial businesses located along Highway 66. Lot 21 proposed for the ZUP is vacant, and WHEREAS, Arizona West, Tract 1112, was recorded June 8, 1971 and is currently under the seventh Extension of time for the completion of improvements. This Extension of Time will end December 16, 1994, and WHEREAS, the zoning for the subdivision was established in 1970 per P&ZC Resolution No. 70-390. Lot 21 is in the SD/C (Special Development/Commercial) zone of the subdivision. The residential lots are zoned R-l, and WHEREAS, the applicant is seeking a Zoning Use Permit for a temporary real estate sales office for the sale of lots in the 22- year-old Arizona West subdivision, and WHEREAS, Resolution NO. 70-390 indicates that all C-2 uses will be permitted in the SOle zone. The Mohave County zoning Ordinance permits mobile homes as sales offices ~n C-2H zones. Mobile home sales offices are not permitted uses in C-2 zones. The amendment of p&Ze Resolution 70-390 will permit C-2H uses. If the amendment is not approved, the Planning staff would recommend denial of the mobile home sales office, and ~. PAGE 2 OF 3 ~K ~499 PG 9~9 (F~E~94-71290) WHEREAS, the Fire Chief of the Valle Vista Fire District has raised some significant fire protection concerns for the development of this site. Even though the use on the site will not be permanent, the site will be utilized in a commercial capacity. Commercial structures need to be within 500 feet of a fire hydrant. There are no fire hydrants on or near the site. The Cliief e~pressed further concern over the addition of a commercial structure in an area where two commercial buildings already exist without fire hydrants, and WJlEREAS, this item was heard before the Planning and zoning Commission at the December 8, 1993, meeting. Staff had recommended denial of the Zoning Use Permit because temporary sales offices are not permitted in C-2 (General-Commercial) zones. The Planning and Zoning Commission recommended approval of the ZUP subject to standard ZUP conditions, and WHEREAS, at the February 13 , 1994, Board of Supervisors meeting the Board referred this item baCk to the Planning and Zoning Commission. This would allow the owner of the property to amend the SD/C zoning for the subdivision. An amendment has been submitted to change the commercial designation for the site to permit C-2H uses, and WHEREAS, review of Floodplain Map #040058-2025B indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations. 2. That appropriate zoning, building, floodplain permits be obtained. environmental and 3. The sales office to be used for sales of homes and lots in Arizona west, Tract 1112, only. 4. If construction or use has not commenced within one year of Board approval of the Zoning use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. .... . . RESOLUTION NO. 94-436 Page 3 PAGE 3 OF 3 BK 2~99 PG 9JO (FEE~94-71290) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Soard of Supervisors, at their regular meeting on Monday, December 5, 1994, APPROVED this zoning use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
