PAGE 1 Of 3 MOKAVE COUNTY BOARO OF SUPERVISORS RrCOROING FEE 0.00 Ne RESOLUTION NO. 94-431 A RESOLUTION SETTING FORTH A REZONE OF PARCELS 33 AND 34, SECTION 9, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R (AGRICULTURAL-RES~DENTIAL) ZONE TO C-2 (GENERAL-COMMERCIAL) AND A-R (AGRICULTURAL-RESIDENTIAL) ZONES IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to La Questa Limited Partnership of Baldwin Park, California, and WHEREAS, the land is located west of the Highway 93 and 68 interchange on the southern side of Highway 68. The site is accessed on the northern side of the property direct1y from Highway 68 or from Highway 68 via Magma Road, then south to the site, and WHEREAS, there is a Preliminary Subdivision Plan proposed for this site known as La Quest a Subdivision, Tract 3020. The plan proposed two commercial sites adjacent to Highway 68, and residential and mobile home lots on the remainder of the parcel. The owner has decided to revise the plan which will require the subdivision to go back to the Sketch Plan stage. The new plan will increase the size of the commercial parcels and will remove the mobile home park portion of the plan. The minimum lot size of the residential lots will also be increased, and WHEREAS, the owner is proposing the rezoning to create three individual parcels. This will permit the development and sale of the individual parcels. The owner has indicated the commercia1 parcel will be developed with a commercial center. The southern portion of the property will become a part of the new plan for La Questa Subdivision. The southern portion of the property will be rezoned to single family residential after approval of the new Preliminary Plan of the subdivision, and WHEREAS, the roadway easement running between the two parcels is being proposed for abandonment. This will create one large parcel on the southern portion of the site, and WHEREAS, review of Floodplain Map #040058-23258 indicates this parcel is located in Zone C, an area of minimal flooding, and RESOLUTION NO. 94-431 Page 2 . . . ~AGE 2 OF J BK 2499 PG 916 (F(Et9~-712&5) WHEREAS, at the pUblic hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the Commission recommended APPROVAL for a rezone subject to the following: 1. The two northern parcels be zoned C-2/6A (General- Commercial/Six Acre Minimum Lot Si~e) and the southern parcel be zoned A-R/36A (Agricultural-Residential/Thirty-six ACre Minimum Lot Size). 2. Submi ttal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations, and 102.04-8 of the Standard Specifications. 3. The Board of Supervisors accepts the dedication of a 30-foot roadway along the east and west boundaries, a 42-foot roadway along the south boundary, and 20-foot radius curves at the southeast and southwest corners of the property. 4. The granting of an eight-foot PUE and DE on the east, south and west sides of the property. 5. The dedication and granting required by the Rezone resolution shall be shown on the parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations and compliance with Section 27.P (Site Plan Requirements). 7. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for deve10pment, or cause the property to revert to its former zoning Classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11- 832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 5, 1994, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
