RESOLUTION NO. 94-430 A RESOLUTION SETTING FORTH A ZONING USE PEIYU'r ON LOT 1, BLOCK A, GOLDEN SACE RANCHOS, UNIT 54, SECTION 1, TOWNSHIP 21 NORTH, RANGE 1S WEST, FOR THE ESTABLISHMENT OF AN AUTO WRECKING/IMPOUND YARD IN AN A (GENERAL) ZONE, IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA.. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permi t for the above described property to Bill Mills of Kingman, Arizona, and WHEREAS, the land is located approximately two miles northwest of the Highway 93 and 68 interchange. The property is accessed from Agua Fria Road on the north side of the site or directly from Highway 93, and WHEREAS, surrounding land uses consist of scattered residential homes to the south, east and west, with vacant state land to the north, and WHEREAS, the property has a number of uses in operation. There is an RV park on the western and southern portions of the lot with approximately 25 spaces. The RV park was approved in June, 1989 by P&ZC Resolution No. 89-120. An Extension of Time for the RV park was granted per BOS Resolution No. 91-217. Fronting Highway 93 is a commercial building and an auto service station. The service station is being used for auto repair and a towing business. There are gas pumps on the site that are not in use which the owner has indicated will be removed. The owner would like to obtain the Zoning Use Permit to allow the storage of vehicles that will be towed to the site, and WHEREAS, the lot is zoned A (General) which permits auto wrecking yards with a Zoning Use Permit, and WHEREAS, the applicant is requesting a Zoning Use a violation due to vehicles stored on the property. the site is also in violation, but is not in relation Zoning Use Permit, and Permit to clear The RV park on to the proposed WHEREAS, at their meeting on Tuesday, September 6, 1994, the Mohave County Board of Supervisors referred this item back to the Planning and Zoning Commission. The Commission denied this Zoning Use Permit at their meeting of August 10, 1994, and " . . RESOLUTION NO. 94-430 Page 2 PAGE 2 OF 4 BK 2506 PG 444 (FEE~94-74067) WHEREAS, the Planning and Zoning staff originally recommended approval for the ZUP based on the fact that the Mohave County Zoning Ordinance permits wrecking/impound yards in "A" zones after acquiring a Zoning Use Permit, and WHEREAS, the property is located within the Golden Valley/ Sacramento Valley Area Plan and is within the Urban/Building Overlay Zone, and WHEREAS, review of Floodplain Map #040058-21508 indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the Commission recommended OENIAL for a zoning Use Permit, and WHEREAS, at the public hearing before the Mohave County Board of Supervisors on December 5, 1994, the Board recommended APPROVAL for a Zoning Use Permit subject to the following: 1. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations. 2. That appropriate zoning, building, floodplain permits be obtained. environmental and 3. The only portion to be used as an impound yard is that portion indicated in Exhibit "A". 4. The impound area be enclosed by a view obscuring fence. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
