RESOLUTION NO. 94-426
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF PARCEL
46, AS SHOWN ON A RECORD OF SURVEY RECORDED AUGUST 22, 1975 IN BOOK 1,
PAGE 27 AND PAGE- 43, RECORDS OF MORAVE COUNTY I LOCATED IN SECTION 10,
TOWNSHIP 21 NORTH, RANGE 18 WEST FOR THE ESTABLISHMENT OF A SWAP MEET
IN A C-2 (GENERAL COMMERCIAL) ZONE IN THE GOLDEN VALLEY AREA, MORAVE
,
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of
Supervisors held on December 5, 1994, a public hearing was conducted
to determine whether approval should be granted for a Zoning Use
Permit for the above described property to Jim Kuden, Go1den Valley,
Arizona, and
WHEREAS, the property is located south of State Highway 68 and
west Of Aztec Road. The property is accessed from State Highway 68
via Aztec ROad, then west to the site. The site is 3.3 miles West of
the intersection of State Highway 68 and United States Highway 93, and
WHEREAS, this property is presently in violation of the MOhave
County Zoning Regu1ations. There is currently a mini-storage and swap
meet on the property, and
WHEREAS, this Zoning Use Permit will correct the zoning
violation, and
WHEREAS, surrounding land uses consist of vacant land to the
west, east and south. The property on the north side of Highway 68 is
vacant with a commercial business on the northeast corner of Highway
68 and Aztec Road, and
WHEREAS, review of Floodplain Map #040058-2325B indicates this
parcel to be in zone A, FEMA special flood hazard area. A Floodplain
Use Permit is required for any development, and
WHEREAS, at the public hearing before the Mohave County Planning
and Zoning Commission on November 9, 1994, the Commission recommended
APPROVAL for a Zoning Use Permit subject to the following:
1. The applicant comply with all applicable provisions of the
Mohave County Zoning Regulations and Section 27.P (Site Plan
Requirements) .

2. That appropriate zoning, building, environmental and
floodplain permits be obtained immediately upon approval of
this Zoning Use Permit since the swap meet is in operation.
3. This Zoning Use Permit is subject to revocation upon 60 days
notification by the Board of SupervisOrs if, in the opinion
of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and
welfare.
4. This Zoning Use Permit will not become effective until all
the conditions of the Rezone resolution for this property
have been met and the new zoning is in effect.
WHEREAS, the notice of hearing was published in the Kingman Daily
Miner, a newspaper of general circulation in Kingman, Mohave County,
Arizona, November 20, 1994, and posted November 18, 1994, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their X'egular meeting on Monday, December 5, 1994, APPROVED this
Zoning Use Permit as recommended by the Mohave County Planning and
zoning Commission and outlined herein.
