RESOLUTION NO. 94-425 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF PARCEL 46, AS SHOWN ON A RECORD OF SURVEY RECORDED AUGUST 22, 1975 IN BOOK 1, PAGE 27 AND PAGE 43, RECORDS OF MORAVe: COUNTY, LOCATED IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Jim Kuden, Golden Valley, Arizona, and WHEREAS, this parcel is part of the recorded Preliminary Plat for Aztec Junction, Tract 3019, and was zoned C-2 via P&ZC Resolution No. 88-150. This rezone will invalidate the existing Aztec Junction, Tract 3019, preliminary Plat and will require a resubmission of the Aztec Junction tract without this parcel, and WHEREAS, P&ZC Resolution No. 88-150 will have to be rescinded based on the removal of this parcel from Aztec Junction, Tract 3019, and WHEREAS, the property is accessed from Highway 68 via Aztec Road, then west to the site. The site is 3.3 miles west of the intersection of Highway 68 and Highway 93, and WHEREAS, this property is presently in violation of the Mohave County Zoning Regulations. There is currently a mini-storage and swap meet on the property, and WHEREAS, surrounding land uses consist of vacant land to the west, east and south. The property on the north side of Highway 68 is vacant with a commercial business on the northeast corner of Highway 68 and Aztec Road, and WHEREAS, the Rezone will allow a Zoning Use Permit to correct the zoning violation which will allow a swap meet on this property, and t . . Hendrix, P.E., in a memo dated October 17, 1994, states, "A good portion of the above described commercial property is located within a Zone A Area of Special Flood Hazard Area of 100-year flood, base flood elevations and flood hazard factors not determined. The Drainage reports for Aztec Junction, Tract 3019, 'depict this commercial area as a wash conveying runoff from Highway 68 around this proposed development. We are requesting that a detailed drainage report be required for this area depicting improvement necessary to protect the proposed use of this commercial property from flooding from the 100- year storm event. We also request this application for Rezone be postponed until this report be evaluated and approved by Public Works. In addition, concurrence should be obtained from ADOT for the method of accessing this property from Highway 68.", and WHEREAS, review of Floodplain Map #040058-2325B indicates this parcel to be in Zone A, FEMA special flood ha~ard area. A Floodplain Use Permit is required for any development, and WHEREAS, the Golden Valley Area Plan indicates this area as commercial, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The property be zoned C-2/7A (General Commercial/Seven Acre Minimum Lot Size). 2. Planning and zoning Commission Resolution No. 88-150 be rescinded based on the removal of this parcel from Aztec Junction, Tract 3019. 3. That the following improvements will be completed within 90 days of the approval of this rezone. 4. That a detailed drainage report be required for this area depicting improvements necessary to protect the proposed use of this commercial property from flood~ng from the 100-year storm event. 5. The Rezone will not be in effect until the drainage report can be evaluated and approved by Public Works. 6. That concurrence has been obtained from ADOT for the method of accessing this property from Highway 68. 7. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations and Section 27.P (Site Plan Requirements) . 9. The rezone shall not become effective until 30 days after final approval of the change in clasSification by the Board of Supervisors, as per ARS ll-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 5, 1994, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
