A RESOLUTION SETTING FORTH A REZONE OF THE SOUTH 1/3 OF PARCEL 105,
SECTION 14, TOWNSHIP 21 NORTH, RANGE 18 WEST FROM A-R/10A
(AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/3A
(AGRICULTURAL-RESIDENTIAL/THREE ACRE MINIMUM LOT SIZE) ZONE IN THE
GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board of
Superv~sors held on December 5, 1994, a publ~c hearing was conducted
to determine whether approval should be granted for a Rezone for the
above described property to David Lobato of Golden Valley, Arizona,
and
WHEREAS, the property is located east of Aztec Road and north of
Redwall Drive. This land is accessed via Highway 68, then south on
Aztec Road to the site, and
WHEREAS, the property is mostly flat to gently rolling and
vacant. There is one residence to the west and several some distance
to the east, and
WHEREAS, the owner proposes to split the property into three
three-acre parcels. There are several parcels to the west that have
been split down to one acre, and
WHEREAS, there are several significant washes that run through
the property, and
waEREAS, review of FEMA Floodplain Map #040058-23258 indicates
th~s parcel is within Zone C, an area of minimal flooding, and
WHEREAS, at the public hearing before the Mohave County Planning
and Zoning Commission on November 9, 1994, the COmmission recommended
APPROVAL for a Rezone subject to the following:

Acre Minimum Lot Size).

3. That the Board of Supervisors accepts the dedication of a
42-foot right-of-way on the southern boundary known as
Redwall Drive and the west boundary known as Aztec Road; a
30-foot right-of-way along the northern boundary known as
Collin Drive and the eastern boundary known as Heber Road;
and four 20-foot radius curves at th~ southeast, southwest,
northeast and northwest intersection points.
4. That the Soard of Supervisors accepts the granting of an
eight-foot PUE on either side of the lot center line
dividing the lots, and an eight-foot POE and drainage
easement along Aztec Road and Redwall Drive.
5. The dedications and grantings ~equired by the Rezoning
resolution shall be shown on the parcel Plat and accepted by
the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel Shall meet or exceed its respective acreage
exclusive of roadways.
7. Each parcel Shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA
flood zones.

11. If these conditions are not met within one year this
approval will be void. If at the expiration of this period
the property has not been improved to meet the use for which
it was conditionally approved, the Board (after notification
by registered mail to the owner and applicant who requested
the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for
development, or cause the property to revert to its former
zoning ClaSSification. This action is in accordance with
Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-
832.

WHEREAS, the notice of hearing was published in the Kingman Daily
Miner, a newspaper of general circulation in Kingman, Mohave County,
Arizona, November 20, 1994, and posted November 18, 1994, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Monday, December 5, 1994, APPROVED this
Rezone as recommended by the Mohave COunty Planning and Zoning
Commission and outlined herein.
