PAGE 1 OF 2 MOHAVE COUNTY BOARD Of SUPERVISORS RfCORDI~ FEE 0,00 Ne ij!CROFlLMEft RESOLUTION NO. 94-423 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 3-A, BEING A PORTION OF SECTION 3, TOWNSHIP 18 NORTH, RANGE 22 WEST, AS SHOWN IN PARCEL PLAT BOOK 4, PAGE 33, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-MO (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave COunty Board of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property to Four Kings Engineering, Inc., Mohave Valley, Arizona, and WHEREAS, the land is located west of Highway 95 and south of Lipan Boulevard. Legal access to the site is accessed from Highway 95 by Boundary Cone Road, then west one-half mile to a 60-foot roadway easement, then north one-half mile to a 60-foot roadway easement, then east one-quarter mile to another 60-foot roadway easement, then north to the site. Legal access to this site has not been improved. The site is being accessed from Highway 95 by a dirt road running west to the site, and WHEREAS, the owner has indicated that the developer of the property to the north may be creating a roadway from Highway 95 that would provide direct access to Parcel A from the highway, and WHEREAS, surrounding land uses are vacant. The Fort Mojave Indian Tribe is using the area further to the west for agricultural purposes, and WHEREAS, there is a mobile home, metal building and some assorted equipment on the site, and WHEREAS, the property is zoned A-R (Agricul tural-Residential) with the property to the west and south also zoned A-R. The property to the east is zoned C-2 (General-Commercial) and the property to the north zoned M (Manufacturing), and WHEREAS, the property to the north zoned M is in the process of being developed to permit a single family residential subdivision. The Board of Supervisors approved the zoning for the subdivision at their October 4, 1994 meeting. The property to the east has an approved Zoning Use Permit to allOW an RV park to be constructed and the property to the west has an approved Zoning Use Permit for a mobile home park, and . . . RESOLUTION NO. 94-423 Page 2 PAGE 2 OF 2 BK 2f99 PG 898 (FEEt9f-71278) WHEREAS, the proposed developments in the vicinity indicate the land in the area is becoming residential. Any commercial manufacturing in this area will create a conflict in land uses, and WHEREAS, the South Mohave Area Plan indicates this area as A-R or low density residential, and WHEREAS, review of Floodplain Map #040058-2445C indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the Commission recommended DENIAL for a rezone based upon the following: 1. The zone change is not consistent with the surrounding proposed land uses. 2. There is no direct access to the site from Highway 95. All traffic will have to pass through residential property. 3. This change will create manufacturing property owners. a conflict between the commercial owner and residential property 4. The proposed zone change is not in conformance with the South Mohave Area Plan. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave COunty Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 5, 1994, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
