RESOLUTION NO. 94-422 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 9, BLOCK 2, BERMUDA DUNES, TRACT 4039-A, SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST FOR THE ESTABLISHMENT OF AN OFF-PREMISE SIGN IN A C-2H (GENERAL COMMERCIAL/HIGHWAY FRONTAGE) ZONE IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 5, 1994, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property to Bill Parker, Martin Media, Fort Mohave, Arizona, and WHEREAS, the site is located on the west side of Harbor Avenue between Plantation Drive and Empire Road. It is accessed from State Highway 95 south and then south on Harbor Avenue, and WHEREAS, the proposed location meets the zoning and spacing requirements for an off-premise sign. The Arill:ona Department of Transportation (ADOT) requires the Off-premise sign to be located within 1000 feet of an established commercial business. The sign is on property occupied by B.B.M. Repair Shop. The Arizona Department of Transportation has issued a permit dated August 1, 1994, and WHEREAS, during the site review for this Zoning Use Permit ten blank sign faces were counted between the Needles Bridge and the Bullhead City city limits, and WHEREAS, the Mohave County Assistant Public Works Director, Michael P. Hendrix, P.E., in a memo dated October 17, 1994, states: "We do not recommend allowing placement of a commercial billboard within the drainage easement. The easement in question was granted to the public for specifiC drainage purposes only. The placement of any permanent structures within this easement could diminish its use and hinder future maintenance. Since this easement was granted to the public for its intended purpose, we can not ascertain what benefit allowing commercial property within this easement would provide to the public as a whole. In addition, Harbor Avenue is a State Route. Harbor Avenue is also a high accident area. The State of Arizona should be allowed to review and comment on any placement of possible visual obstructions along said route.", and . " . . RESOLUTION NO. 94-422 Page 2 ~A6E 2 OF 2 BK 2499 PG 896 (FEE~94-71271) WHEREAS, review of Floodplain Map #040058-2615C incUcates this parcel is located in Zone B, an area not in a FEMA flood hazard area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 9, 1994, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. The incompatibility with the surrounding residential uses. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 20, 1994, and posted November 18, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 5, 1994, DENIED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
