RESOLUTION NO. 94-405
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE E~ OF THE E~ OF
LOT 83, GATEWAY ACRES, TRACT 10, SECTION 19, TOWNSHIP 25 NORTH, RANGE
19 WEST FOR THE ESTABLISHMENT OF A WRECKING YARD/REPAIR FACILITY IN AN
A (GENERAL) ZONE, IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of
Supervisors held on November 3, 1994, a public hearing was conducted
to determine whether approval should be granted for a Zoning Use
Permi t for the above described property to Clarence and Thomasine
Apple of Dolan Springs, Arizona, and
WHEREAS, the property is located east of Highway 93 and south of
Pierce Ferry Road. The land is accessed from Highway 93 via Pierce
Ferry Road, then northeast to Calico Drive, then south to the site,
and
WHEREAS, the surrounding land uses consist of vacant land and
scattered residential homes. There are a few commercial businesses to
the north along Pierce Ferry Road, and
WHEREAS, there is a single family home and a number of vehicles
on the property. There is vegetation on the property that obscures
the home from the road and provides some buffering from the
surrounding properties, and
WHEREAS, the owner is operating an auto repair service on the
property and is in violation of the Mohave County Zoning Regulations,
and
WHEREAS, general commercial uses are permitted in "A" zones with
all activities taking place indoors. General commercial zoning
permits light auto repair in connection with a service station. No
vehicles can be stored outside, and
WHEREAS, the owner of the property applied for a Rezone to C-2H
to remove the zoning violation. The Planning and Zoning Department
recommended denial of the request because the site does not meet the
requirements for C-2H zoning. The Department pointed out to the owner
that wrecking yards are permitted uses in A (General) zones. The C-2H
zoning request was withdrawn by the owner and an application for a
Zoning use Permit for a wrecking/repair facility was submitted, and

WHEREAS, General or "A" zoning permits wrecking yards if approved
by a Zoning Use Permit, and
WHEREAS, review of Floodplain Map #040058-1775B indicates this
parcel is located in zone C, an area of minimal flooding, and
WHEREAS, at the public hearing before the Mohave County Planning
and Zoning CommiSSion on October 12, 1994, the Commission recommended
APPROVAL for a Zoning Use permit subject to the following:
1. The applicant comply with all applicable provisions of the
Mohave County Zoning Regulations.
2. The wrecking yard and repair facility be enclosed by a view
obscuring fence to be completed prior to commencement of
operation of the wrecking yard/repair facility.

4. If construction or use has not commenced within one year of
Board approval of the Zoning Use Permit or if the use has
been discontinued for six months, then approval shall
terminate at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days
notification by the Board of Supervisors if, in the opinion
of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and
welfare.
WHEREAS, the notice of hearing was publ~shed in the Kingman Daily
Miner, a newspaper of general circulation in Kingman, Mohave County,
Arizona, October 16, 1994, and posted October 17, 1994, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Thursday, November 3, 1994, APPROVED this
Zoning Use Permit as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
