PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0,00 Ne 6 RESOLUTION NO. 94-383 A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY PLAN OF CAMP MOHAVE HEIGHTS, TRACT 4086, BEING A SUBDIVISION OF A PORTION OF THE s\ OF THE NE~ OF THE NE%, SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Soard of Supervisors held November 3, 1994, a publ~c hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved Preliminary Plan of Camp Mohave Heights, Tract 4086, and WHEREAS, this item was referred back to the Planning Commission from the July 5, 1994, meeting of the Mohave County Board of Supervisors to address conflicts between the drainage easements on the front and sides of the lots within the subdivision and provision of adequate space for septic systems, and WHEREAS, meetings and correspondence between the Engineer of Record, purchasers of the subdivision, County Environmental Health staff and the Arizona Department of Environmental Quality have identified a solution to the problem, and WHEREAS, the owners/developers of this tract are Lori Hathaway, Rolling Hills Estates, California, and Lorraine Healton, Menefee Valley, California. The engineering firm responsible for the preparation of the drainage report and design was McLaughlin-Kmetty Engineers, Ltd., Glendale, Arizona. Stovall Engineers, Inc., Bullhead City, Arizona, is currently representing the developer, and WHEREAS, the subdivided into 79 11,394 square feet, submitted Prel~minary Plan depicts 20 acres lots. Lot sizes range from 7,785 square feet to providing a density of 3.94 units per acre, and WHEREAS, according to the developer, water and telephone will be supplied by Citizens Utilities Company, electric power will be supplied by Mohave Electric, and fire protection will be provided by the Fort Mojave Mesa Fire Department. Sewage disposal will be accommodated by individual on-site septic systems. Solid waste will be removed by Tri-State Refuse and transported to the Mohave County Landfill, and . . RESOLUTION NO. 94-383 Page 2 WHEREAS, Article 3.10-1 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one year may be granted by the aoard if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, in a letter dated May 5, 1994, G. Kelly Grier, Stovall Engineers, Inc., stated that one of the partners has been seriously ill. An additional partner has been added to the corporation, and the financial package for the Assurances is being assembled. submittal of the Final Plat will be made as soon as the Assurances are guaranteed, and WHEREAS, in a letter dated August 30, 1994, Denise Stovall- Burton, Stovall Engineers, Inc., requests that the County proceed with the Extension of Time based upon information received during a meeting wi th County Health Department staff and the buyers of Camp Mohave Heights. She asked that the approval be conditional upon revision of the plan and drainage report to eliminate the side and front drainage easements, or upon provision of sewer to the site, and WHEREAS, the Preliminary Plan for this tract was approved via Resolution No. P&ZC 89-88 on May 10, 1989. The Final Subdivision Plat approval and zoning for Phase "A" was established via BOS Resolution No. 90-34 on February 5, 1990. BOS Resolution No. 92-246 established the Final Plat approval for Phase "B" on July 6, 1992. Phase "A" has been recorded; Phase "B" has not. The first Extension of Time was granted by the Board on June 1, 1992, via ReSOlution No. 92-l80. BOS Resolution No. 93-124 granted the second Extension of Time. This will be the third Extension of Time, and 1994, the Mohave APPROVAL of the WHEREAS, at a public hearing on October 12, County Planning and Zoning Commission recommended requested Extension of Time subject to the following: 1. Compliance with all conditions as stated in Resolution No. P&ZC 89-88 and BOS Resolution No. 92-246. 2. The Drainage Report must be revised to eliminate drainage easements along the sides and fronts of the lots, or sewer must be provided to the subdivision. 3. This Extension of Time will be in effect until June 1, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona on October 16, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 94-383 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, November 3, 1994, APPROVED the Extension of Time for Camp Mohave Heights, Tract 4086, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
