PAGE 1 OF + HDHAVi COUNTY BOARD OF BUPERVISORS RECORDING rEE . 0.00 HC RESOLUTION NO. 94-382 A RESOLUTION SETTING FORTH APPROVAL OF AN ~XTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF BEAVER DAM RESORT, TRACT 3015, BEING PORTIONS OF SECTIONS 4 AND 5, TOWNSHIP 40 NORTH, RANGE 15 WEST, LOCATED IN THE L:ITTLEFIELD/BEAVER DAM PORTION OF THE AR:IZONA STRIP AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the MOhave COunty Board of Supervisors held November 3, 1994, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the approved preliminary Plan of Beaver Dam Resort, Tract 3015, and WHEREAS, the owner/developer of this tract is G. R. Frisby of Beaver Dam, Arizona. The engineer responsible for the preparation and design of this subdivision was Phylip Leslie, P.E., Rowley-Leslie Associates, Cedar City, Utah. The drainage study for the Beaver Dam Wash was prepared by Frank R. Liebrock and Hooper Knowlton, Jr., P.E.s, with A/E Intra Group, Inc., Salt Lake City, Utah, and WHEREAS, this subdivision is located in the Arizona Strip, approximately one mile north of the I-l5/Littlefield interchange along County Route 91. The SUbdivision is bounded by County Route 91 to the west and the Virgin River to the north. Access is provided to this proposed subdivision by County Route 9l, and WHEREAS, as originally approved, this subdivision is a 32-acre parcel subdivided into 206 park model and RV lots, 33 twin-home lots (66 units), and an 11-acre common area which did not include the golf course to be owned and maintained by the owner/subdivider, and WHEREAS, the Planning and zoning Commission continued this item at the July, 1994, meeting and instructed staff to review the file and determine whether the project should be brought up to current standards as had been required by Bas Resolution No. 91-260 on October 7, 1991. On May 20, 1992, a BOS Minute Entry amendment to BOS Resolution NO. 9l-260 allowed the subdivision to be completed as designed when the Final Plat (Tract 3015-B) was approved, and WHEREAS, Phase "A", Tract 3015-A, the western one-fourth of this subdivision, was recorded on October 23, 1987. This phase inCluded 45 lots, two landscaped parcels, two open space parcels and private streets, and RESOLUTION NO. 94-382 Page 2 . . WHEREAS, Phase "8", Tract 30l5-B, the eastern three-fourths of this subdivision, reoeived final approval on October 3, 1988, but was never recorded. This phase included the remainder of the approved Preliminary Plan. The phase included 225 lots and several open space and public utility easement/drainage easement parcels, and WHEREAS, upon performing the in-depth review it was discovered that several variations from the approved Final Plat for 3015-B have been submitted since the Minute Entry Amendment by the Board of Supervisors on May 20, 1992. All of these submittals have been different than the Final Plat (30l5-B) approved by the BOS on October 3, 1988, and WHEREAS, during a meeting with the Planning and Zoning Department Mr. Frisby and his Engineer of Record, Phylip Leslie, submitted a Preliminary Plan, Revised Phasing Plan and Final Plat for Beaver Dam Resort, Tract 3015-B. This Preliminary Plan substantially complies with the originally approved Final Plat for Beaver Dam Resort, Phase II, Tract 3015-B, Engineer's Stamp dated October 3, 1988. Mr. Frisby indicated that he now intends to pursue development of the originally approved Final Plat (in phases) and will develop it as delineated on the submitted Revised Phasing Plan. Areas destroyed during the flooding of the creek in 1991 will be reclaimed and developed as permitted by the Army Corps of Engineers, and WHEREAS, the Final Plat now being submitted for approval is dated 9-22-94 (on the Engineer's Stamp). It depicts 45 RV/travel trailer lots south of Clark Gable Drive, Parcel "E" (Roadway, Drainage, and Public utility Easement for Clark Gable Drive, Jane Russell Way, Jack Benny way, and Scarlet O'Hare Drive), parcels "I", "K", "H", and "N" (open spaces to contain landscaping and public walkways), and Parcel "P" (Open Space/Recreation parcel which contains the common drainfield for Tract 3015-B). According to the CC&Rs parcel "P" will be owned and controlled by the Beaver Dam Property Owners Association Inc. and may be developed or improved for common area uses to benefit all of the property owners in Beaver Dam Resort when the common drainfield is abandoned, and WHEREAS, according to Mr. Frisby, this is the last development of Beaver Dam Resort, Tract 3015, which will be allowed on-site septic systems by the Arizona Department of Environmental Quality. A wastewater treatment facility must be constructed on site before development of future phases will be considered, and WHEREAS, the Mohave County Subdivision Regulations, Article III, Section 3.10-1 states: Upon application to the Commission, and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated, and PAGE 2 OF <l- ~K 2488 PG g~ (FEEt94-65849l . . RESOLUTION NO. 94-382 Page 3 WHEREAS, in a letter dated May 4, 1994, received by Planning and Zoning on May 11, 1994, Mr. Bob (G. R.) Frisby advised that submittals have been made to the Arizona Department of Environmental Quality and approval is expected in the near future. When ADEQ approval is obtained, the issues delineated by staff in the letter of January 7, 1994, will be addressed, and WHEREAS, the Certificate of Approval to wastewater Facilities was signed by the Director and Permits Unit on September 9, 1994, and Construct Water and of ADEQ's Engineering WHEREAS, review of the submitted documentation indicates that the subdivision will substantially comply with today's standards. Electricity, telephone, water with fire flows, common septiC systems, and curbs and gutters are being provided. Each lot will have an improved area which includes grass and a concrete patio. The only area which would pose a problem by today's standard is the very small lot size and setbacks. Lots in Phase 3015-B range in size from 1,800 to 3,624 square feet. Approved setbacks were five feet for the front, rear and side. Materials submitted to the Planning Division and Department of Public Works by Mr. Frisby and his Engineer of Record now satisfy the major concerns of staff, and WHEREAS, the Preliminary Subdivision plan was approved by the Mohave County Board of Supervisors on July 6, 1987, via P&ZC Resolution NO. 87-100. The rezone (SD/R) for this subdivision was granted via BOS Resolution NO. 87-101 on June l, 1987. BOS Resolution No. 91-260 brought the project into compliance by granting the first, second and third Extensions of Time, effective until July 6, 1992. This Extension of Time was conditional upon the approved Final Plat for Tract 3015-B, being brought up to today's codes, and WHEREAS, on May 20, 1992, BOS Resolution No. 91-260 was amended by the Board of Supervisors via a Minute Entry action at the request of Mr. Frisby. This action approved the Extension of Time with the same three conditions as originally applied (provide financial assurances, provide acceptable Engineer's Cost Estimate, and provide evidence of AOEQ approval for the sewage disposal system) . BOS Resolution No. 92-251 granted the fourth Extension of Time, effective until July 6, 1993. BOS Resolution No. 93-247 granted the fifth Extension of Time on September 7, 1993. BOS 93-247 expired on July 6, 1994. This will be the sixth Extension of Time, and WHEREAS, at a public hearing on October 12, County Planning and Zoning Commission recommended requested Extension of Time subject to the following: 1994, the Mohave APPROVAL of the 1. Phases of development being submitted to the County for review and recordation must conform to the Preliminary Plan/Phasing Plan submitted during the staff/Frisby meeting on 8-3-94, with corrections addressed on plans dated 9-22-94 (on the Engineer's Stamp), as requested by staff. 3. Any deviation away from this approved design (Preliminary Plan, Tract 3015, dated 9-22-94 on the Engineer's Stamp) will require submittal of a revised Preliminary Plan for review and approval by the Planning Commission and the Board of Supervisors. Changes in phasing plans may be approved administratively by the County Departments involved in the review process, but that approval must come in advance of submittal of Final Plats. 4. Since the originally approved tract will not be recorded and only one tract (3015-B) can be recorded, the originally approved Final Plat for Beaver Dam Resort, Phase II, Tract 3015-B (Engineer's Stalup dated 7-1-88, 265 lots) must be rescinded. Said rescission will occur with the recordation of the Final Plat for Tract 3015-B (Engineer's Stamp dated 9-22-94, 45 lots). 5. This Extension of Time will be in effect until July 6, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona, on October 16, 1994, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, November 3, 1994, APPROVED the Extension of Time for Beaver Dam Resort, Tract 3015, as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
