PAGE 1 OF" 2 .... .-;;- " HOHAVE COUilTY BOARD OF SUPEIW!SORS RfCORD!NG I'EE 0.00 HC RESOLUTION NO. 94-358 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO 93-168 WHICH SET FORTH A REZONE OF A PORTION OF THE N~, N~, N~, OF THE NW\. SW%, SECTION 22, TOWNSHIP 16 NORTH, RANGE 13 WEST, LYING WEST OF ARIZONA STATE HIGHWAY 93, FROM A (GENERAL) ZONE TO A-R/1A (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1994, a public hearing was conducted to determine whether approval should be granted for an amendment to the legal description for a Rezone on the above described property, and WHEREAS, this resolution is being amended to more clearly define the legal description. The legal description includes new language underlined, indicating that this parcel is located west of Highway 93. All other new language is bolded, and WHEREAS, the subject property is located on Highway 93 approximately ten (10) miles north of Wikieup. The property currently has a mobile home located on the rear portion of the property, and the surrounding land uses consist of commercial businesses on the north and south sides of the property and vacant land to the east and west of the parcel. There is a small wash running along the northern side of the parcel, and WHEREAS, review of floodplain map #040058-2913B indicates this Parcel to be clear of a designated floodplain. The applicant desires to split this two plus (2.99) acre parcel into two (2) one (1) plus acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 14, 1994, the Commission recommended APPROVAL for an amendment to Resolution No. 93-168 subject to the following: 1. The two parcels be zoned A-R/1A (Agricul tural-Residential/ One Acre Minimum Lot Size). 2. This shall be approved through the recording of the resolution authorizing this zone change, and that the granting statement to be shown on the Parcel Plat. 6. The Rezone shall not become effective for thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARB 11-829E. 7. If these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the sChedule for development or cause the property to revert to its former zoning classification in. accordance with Arizona Revised, Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 18, 1994, and posted September 16, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, October 4, 1994, APPROVED this amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
