A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO 90-315
WHICH SET FORTH A REZONE OF A PORTION OF THE N~, N~, N~, OF THE NW\,
SW\, SECTION 22, TOWNSHIP 16 NORTH, RANGE 13 WEST, LYING EAS'L-QF
ARIZONA STATE HIGHWAY 93, FROM A (GENERAL) ZONE TO C-NO (COMMERCIAL-
MAUFACTURING/OPEN LOT STORAGE) ZONE IN THE MOHAVE COUNTY GENERAL AREA,
NOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of
Supervisors held on October 4, 1994, a public hearing was conducted to
determine whether approval should be granted for an amendment to the
legal description for a Rezone on the above described property, and
WHEREAS, this resolution is being amended to more clearly define
the legal description. The legal description includes new language
underlined, indicating that this parcel is located east of Highway 93,
and
WHEREAS, the property is located on the east side of Highway 93
in Wikieup and is approximately one-fourth mile north of Chicken
Springs Road. This 2.01-acre parcel was created when half of as-acre
parcel, split by Highway 93, was sold to the applicant. All of the
parcels along Highway 93 in Section 22 and 27, a two-mile strip, were
zoned A (General) when zoning was extended to this area in 1968.
These A zoned parcels have developed with service stations, cafes, and
other highway-oriented service businesses, together with single family
residences. The State Highway Department and Citizens Utilities
Company have facilities approximately one-fourth mile south ot this
property. The above mentioned parcels range from one-half acre to 40
acres in size. There are other parcels split by the highway right-ot-
way that could create parcels less than the 5-acre size minimum
allowed in an A zone, and
WHEREAS, because the parcel in question is under five acres, the
applicant is requesting a C-MO zone which would allow an impound yard
to operate in a parcel not meeting the criteria tor an A zone. The
parcel is approximately one-fourth mile south of an impound yard the
Commission approved on June 6, 1990, and
WHEREAS, at the public hearing before the MOhave County Planning
and Zoning Commission on September 14, 1994, the Commission
recommended APPROVAL for an amendment to Resolution No. 90-315 subject
to the following:

1. The applicant comply with all applicable provisions of
Sections 25, 26, 27 and 31 of the Mohave County Zoning
Regulations.
2. Submi ttal and recordation of a Parcel Plat prepared in
accordance wi th Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-8 of the Standard
Specifications.
3. The establishment of a minimum lot area based on the size of
the parcels per the recorded Parcel Plat.
4. Parcel Plat shall show any surface drainage ways.
5. That a Zoning/Building Permit shall be obtained prior to any
structure being placed/constructed.
6. Any residential structures on this parcel Shall become
nonconforming structures.
7. An Arizona Department of Transportation permit be obtained
for any driveway providing access to Highway 93.
8. Any open storage must be related to or be an accessory to
the primary business.
9. SuCh storage shall be completely enclosed by a view-
obscuring fence which extends two feet above the highest
item to be stored, with a minimum of six feet and a maximum
of eight feet in height. Such a fence shall display no
advertising.
10. The applicant shall pave the driveway access and parking in
accordance with Mohave County Standard Specification No,
171, or bettar. The storage area shall be covered with a
dust-proof surface. If crushed rock is used for the dust-
proof surface then the soil shall be maintained in a weed
free condition.
11. The Rezone shall not become effective for at least 30 days
after final approval of the change in classification by the
Board of Supervisors, as per ARS 11-829E, and all conditions
of the R~zone have been satisfied.

12. If these conditions are not met within one year this
approval will be void. If at the expiration of this period
the property has not been improved to meet the use for which
it was conditionally approved, the Board (after notification
by registered mail to the owner and applicant who requested
the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for
development, or cause the property to revert to its former
zoning classification, This action is in accordance with
Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-
832.
WHEREAS, the notice of hearing was published in the Kingman Daily
Miner, a newspaper of general circulation in Kingman. Mohave County,
Arizona, September 18, 1994, and posted September 16, 1994, as
required by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular meeting on Tuesday, October 4, 1994, APPROVED this
amendment as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
